
Romania’s salary legislation is flawed. Example: minimum wage for 24 months. On the face of it, this is good, but in practice, due to application, the benefit disappears, affecting those who receive such payment. They will be paid less if they follow it.
Thus, through GEO 130/2021, the minimum salary for 24 months (2 years) appeared. The problem is that in 2024 (due to the trenulet OUG 115/2023) the effect of the minimum wage of 200 lei, which was not taxed, was extended.
If wages are increased by 10 lei because entrepreneurs have to pay more to comply with GEO 130/2021, workers will take in less because those 200 lei will be taxed.
So, with a gross salary of 3,300 lei, the employee receives 2,079 lei. If the salary is increased to 3,310 lei, he will take 2,000 lei, that is, 79 lei less.
Last week, the labor inspectorate said on its Facebook page that it is reminding companies to comply with the minimum wage legislation for 24 months. In other words, it will lead to lower wages.
They would suffer, even if you look at the data of the institution: 406,293 employees.
“The salary increase will be discussed with each employee who meets the seniority condition, and the result will be specified by concluding an additional act signed by both parties, taking into account that the individual employment contract can be changed only on the basis of legal provisions or by agreement of the parties. In order to fulfill these legal provisions, employers will take into account the level of the minimum basic wage in the country, guaranteed in payment, established by the regulatory act,” the Labor Inspectorate also reports.
We remind you that in 2022 HotNews.ro asked the representatives of the Territorial Labor Inspectorate if they would do anything in a situation where some employers decide to terminate these employment contracts and open new ones in the name of the employees, and from the answer sent, we understand that nothing: we cannot apply sanctions.
