
The Competition Council announced on Wednesday that it has opened two investigations into the possible falsification of tenders organized by the National Road Infrastructure Management Company (CNAIR SA) through the Roads and Bridges Directorates (DRDP) of Constanta, Brasov, Bucharest and Timişoara for the awarding of the performance contract works on maintenance of the network of roads of national importance and highways under the management of these areas.
- “The Competition Authority has indications that the companies have coordinated their commercial policies in such a way as to divide their work in public procurement procedures organized by the regional directorates of roads and bridges.
- In this context, the Competition Council conducted surprise inspections at the headquarters of the companies targeted by two investigations: Oyl Company Holding AG SRL, Asfalt Dobrogea SRL, Autoprima Serv SRL, Saga Infrastructură SRL, Trecon Logistic SRL, Tredeco Holding SRL, Data Capture SRL, Geo Drumuri Banat SRL and CLR-Denis Montaj SRL”. the body announced on Wednesday.
Unannounced inspections are authorized by the Bucharest Court of Appeal and are justified by the need to obtain all the information and documents necessary to clarify the possible anti-competitive practices being analyzed. Their compilation is not a preliminary conviction of the guilt of the companies.
If the Competition Council finds a violation of the competition rules, the companies involved face a fine of up to 10% of the turnover.
However, companies that cooperate with the antitrust agency can receive immunity from fines or a significant reduction in fines under the leniency program.
The Competition Law prohibits any agreements between companies and concerted practices that prevent, restrict or distort competition in the Romanian market.
