The Court of Appeal of Iasi reopened the criminal investigation in the case of Bosynchan Kostyantyn Daniel, who was accused of rape, but the case was closed five years ago.

According to the court protocol, the decision to reinstate was made after the notification of the Prosecutor General’s Office.

“Accepts the notification of the Prosecutor’s Office at the High Court of Cassation and, therefore, in accordance with Art. 335 par. (4) of the Criminal Procedure Code, verifies the legality and reasonableness of the decision to declare invalid, contained in Resolution no. 1557/C/2023 dated 30.08.2023 of the Prosecutor General of the Prosecutor’s Office at the High Court of Cassation and Justice, which was ordered by the order dated 19.10.2018 in file no. 66/P/2018 of the Prosecutor’s Office at the Court of Appeal of Iasi regarding the decision on the qualification of the crime of rape, provided for in Art. 218 para. (1) and par. (3) lit. c) with CC. Confirms the renewal of criminal proceedings regarding the crime of rape, provided for in Art. 218 para. (1) and par. (3) lit. c) with CC in case 66/P/2018 of the Prosecutor’s Office at the Iasi Court of Appeal,” the decision reads.

Bosynčanu is the head of the prosecutor’s office at the Raduchanyen Court of Iași County.
