
Senator Robert Kazanchuk (PSD) said Wednesday night on Prima News about the threshold for abuse of office set in the Senate that the CCR made it clear that they had no choice and had to set the threshold, and the draft from the Government really should have deterred this threshold, writes News.ro. We risk not taking money from the PNRR, Kazanchuk argued, noting that a milestone in the PNRR requires that the Criminal Codes be brought into line with these CCR decisions. He also pointed out that the Court’s decisions show that the minimum wage cannot be set as a threshold amount because it is ridiculous.
“We went to the legal committee to discuss the draft law sent by the Government at the end of last year to fulfill the milestone in the PNRR, which very clearly states that we must harmonize the texts of the Criminal Code and Criminal Procedure with the decision of the Central Committee. The government submitted this draft law to the parliament, which harmonizes the texts,” said the PSD senator.
Robert Kazanchuk stated that establishing a threshold for abuse of office is not easy to assume.
“The CRC says, we have no choice, we have to set a threshold, the project that comes from the Government really has to contain this threshold if we are discussing a project that meets the requirements of the Court, because otherwise it will be attacked again and again – such a mistake we we risk not taking money from PNRR, no matter how much it seems like a hallucination. The court says in the decision from 2019 – there are several decisions – that the legislator is obliged to regulate the threshold of the cost of damage and the intensity of damage,” Kazanchuk said, clarifying that the CCR shows that it should not be a ridiculous threshold, the minimum wage level for the economy.
“The legislator should have taken care of determining the intensity of damage with reference to legal rights and freedoms, and not establishing a value threshold in itself… The decision refers to a value threshold set at the level of the minimum wage in the economy,” he stated.

“The Central Committee also says that it must be of a certain severity, with serious consequences. Thus, as a result of the debate, we arrived at this formula, which is obviously not infallible. But we had a silent deadline for adoption in a few days, if it passes silently through the Senate, it will go to the Chamber of Deputies, not even formally respecting the Court’s decision. The government project did not foresee anything about the threshold,” Kazanchuk also noted.
The PSD senator also noted that “the CCR emphasizes that it cannot set for parliament what severity means, the court said where to start and you cannot set a minimum wage because that is ridiculous.” “We are discussing here crimes and progressive liability, civil liability, misdemeanors, other nature, and in this project it is established that up to a certain amount is a misdemeanor,” he added.
About the former PSD leader’s OUG 13, which set a threshold of 200,000 lei, Kazanciu said that there was no PNRR during Dragni’s time that forced Codexes to agree to this decision.
“We had this obligation until December of last year to transpose the Court’s decision with huge risks for Romania, we are in the debate, we are in the first chamber,” he said.
About the 9,000 lei threshold, Kazanchuk said: “It is important that in the end the established threshold gives us a guarantee that if someone attacks this project in the CCR, it will not be rejected because we are blocking the PNRR.”
