Statement regarding the multi-page opinion of Supreme Court Prosecutor Isidoros Dogiakos that the AIAE does not have the authority under current law to consider requests from citizens who ask to know if their phones were tapped for reasons of national security, but none can contact telephone providers, said the honorary Chief Justice Vasiliki Thanos.
Ms. Thanos’ statement
According to Ms. Tanu, “the conclusion of the prosecutor of the Supreme Court can only be described as a mere formulation of a scientific opinion (and legally incorrect in general) and in no way obliges ADAE in the exercise of its powers.
The Communications Confidentiality Authority is an independent body with constitutional protection (art. 19, para. 2 of the Constitution) and its powers are defined by law 3115/2003. Subject to parliamentary control (only), this means independent power.
Any other interference in its work, direct or indirect, undermines its independence.”
