TAS released on Wednesday the reasons for the arbitration decision, which outlines the arguments that formed the basis of the four-year suspension for doping imposed on Kamila Valieva in January.
The Supreme Sports Court found Valieva guilty of an anti-doping rule violation (ADRV) after the presence of trimetazidine (TMZ) in a sample taken from her in December 2021 during the Russian national championship.
TAS notes that in her observations Valieva stated that the prohibited substance entered her body while eating a dessert prepared by her grandfather using a meat grinder, which he used to grind his pills containing TMZ.
“The TAS commission found that this explanation was not supported by any concrete evidence, and the athlete was unable to prove that she did not intentionally commit the ADV.
On this basis and in accordance with the relevant rules, the athlete’s “protected person” status before the special CAS branch during the 2022 Winter Olympics, due to her young age and based on the limited evidence available at the beginning of the case, was no longer applicable in her situation.” TAS reports.
CAS went on to say that since Valieva could not prove that she did not commit ADRV intentionally, and since the “Absence of fault or gross negligence” criterion was not met, there was no reason to treat her differently than an adult athlete.
All of the athlete’s competitive results since the offense have been annulled, including the gold she won with the Russian team at the Beijing 2022 Winter Olympics. Russia has announced that it will appeal the decision to strip her of the medal, News.ro writes.
