Energy suppliers are still waiting for clarification from ANAF and ANRE on how they will bill companies from January 1. They say the legislation is unclear and they fear fines from all sides. Most of the problems will be with consumers, because until now suppliers issued invoices on their behalf, and this is no longer possible.

The electronic invoice format does not contain all the details required by the billing standards issued by the National Energy Regulatory Authority (ANRE). For its part, NARE established these standards in accordance with European legislation.

“We hope to receive a clear position from ANAF in early January. The problem is the electronic invoice format, which does not comply with ANRE and EU regulations,” Laurenciu Urluescu, president of the Romanian Association of Energy Suppliers (AFEER), told HotNews.ro.

According to him, issuing in both formats is a temporary solution, but means additional costs and the risk of fines, because the legislation is unclear.

“The main problem will be the billing of consumers, when bills can no longer be issued in the name of the consumer for the energy supplied to the grid, as was the case until now,” Urluescu added.

E.ON has already informed its customers that it will issue bills in the traditional way

One of the big suppliers, E.ON Romania, has already sent a message to other legal entities (other companies) informing them that they cannot issue their invoices in the e-Invoice system from January 1, 2024, but in the traditional system:

“In connection with the latest regulations on the administration, operation and implementation of the national system of RO electronic accounts in Romania, which derive from the provisions of Law 296/2023 and GEO 115/2023, please keep in mind that in the period 01.01.2024 – 06.30. 2024 E.ON Romania SA will register and pay the invoices received in the traditional format.

This information does not affect your company’s obligation to upload invoices to the national RO eFactura system arising from legislative changes.

As a result, we ask that between 01/01/2024 and 06/30/2024 you send us invoices in the traditional format, the same as before the date of this information, to the email addresses that your company uses for E. ON. Romania SA”
