President Klaus Iohannis announced on Wednesday the regulation banning the sale to minors of all categories of products containing tobacco, e-cigarettes, e-cigarette refills or electronic tobacco heating devices.

As reported in the Presidential Administration, Klaus Iohannis signed on Wednesday the decree on the publication of the law on amendments and additions to some regulatory acts in the field of tobacco products, adopted by deputies on February 27.

The normative act extends the prohibition of sale through vending machines, as well as the prohibition of the sale of electronic cigarettes, refill bottles for cigarettes, and electronic devices for heating tobacco to youth under the age of 18:

• “The sale of all categories of tobacco-containing products, electronic cigarettes, refill bottles for electronic cigarettes, electronic devices for heating tobacco and products for smokeless inhalation of tobacco substitutes, (packages) of nicotine packets for oral use and products intended for inhalation is prohibited. without burning tobacco substitutes for persons under 18 years of age.
• In order to verify the age of persons who buy these types of products, sellers may require the presentation of an identity document.”

At the same time, educational institutions are obliged to introduce in their regulations “enforcement measures applied to students for non-compliance with the provisions relating to the sale/possession and use of all categories of products containing tobacco, electronic cigarettes and electronic devices. for heating tobacco in their premises”.

Smoking is prohibited in schools

On February 27, the deputies adopted several initially rejected amendments.

One of the changes defines an electronic device for heating tobacco and smokeless inhalation products from tobacco substitutes, an electronic cigarette, a refill bottle, a nicotine pouch for oral use, as well as smokeless inhalation products from tobacco substitutes.

It is also prohibited for students of all educational units to smoke, as well as the use of all categories of tobacco products, electronic cigarettes, refill bottles for electronic cigarettes, electronic devices for heating tobacco and products intended for inhalation without burning from tobacco substitutes. , (packages) of nicotine sachets for oral use and products intended for smokeless inhalation from tobacco substitutes.

It is also prohibited to sell through vending machines all categories of products containing tobacco, electronic cigarettes, refill bottles for electronic cigarettes, electronic tobacco heating devices and products intended for inhalation without burning from tobacco substitutes, (pouches) nicotine sachets for oral use and products, intended for inhalation without burning from tobacco substitutes, another adopted amendment provides.

The regulatory act also provides:

• “The sale through easybox/locker type devices of all categories of products containing tobacco, electronic cigarettes, refill bottles for electronic cigarettes, electronic tobacco heating devices and smokeless inhalation products from tobacco substitutes, nicotine containers for oral use and smokeless inhalation is prohibited. tobacco substitute products. These goods, which are sold through courier services, must have a message on the package that is as legible as possible: “Caution! This package contains tobacco products and/or products containing nicotine. Check the customer’s age.”
• In the sanitary permit for the activities of establishments selling tobacco products, electronic cigarettes, refill bottles for electronic cigarettes, electronic devices for heating tobacco and products intended for inhalation without burning from tobacco substitutes, (packages) nicotine sachets for oral use and smokeless inhalation products. of tobacco substitutes, a special clause prohibiting the sale of tobacco products, electronic cigarettes, refill bottles for electronic cigarettes, electronic devices for heating tobacco and smokeless inhalation products made of tobacco substitutes, (packages) nicotine sachets for oral use and products intended for smokeless inhalation of substitutes is introduced tobacco for youth under 18 years old”.

The bill also introduces sanctions of up to 100,000 lei depending on the severity of the crime.

The detection of violations and the application of sanctions are carried out by persons authorized to do so by the Ministry of Health and the National Body for the Protection of Consumer Rights, representatives of the local police or the Ministry of Internal Affairs.

The Ministry of Education establishes the framework regulations on the organization and functioning of units of pre-university education, sanctions applied to students for non-compliance with the provisions related to the sale/possession and use of all categories of products containing tobacco, electronic cigarettes, refill bottles for electronic cigarettes and electronic devices for heating tobacco, in the premises of educational institutions.
