On Monday, a Bucharest court is expected to rule on CJ Prahova president Julian Dumitrescu’s appeal of a judicial review ordered in a case in which he is being investigated by DNA for bribery and false statements. According to the ruling issued by prosecutors, Dumitrescu is also prohibited from performing the administrative functions he holds at the level of CJ Prahova. Iulian Dumitrescu’s defense attorney, Christian Ene, said in the previous term that he submitted several documents to the court that prove the fact that this judicial review is not suitable for Iulian Dumitrescu, writes News.ro.
Iulian Dumitrescu challenged the judicial review measures taken against him by DNA prosecutors in a Bucharest court, the court considered his request on Thursday, but the decision was postponed until February 12.
When the deadline expired Thursday, his lawyer, Christian Aene, said in court that the judicial review measure was being challenged so that a judge could determine whether it was justified.
He also referred to the interpretation of the amount cited by prosecutors in the bribery case, saying the amount refers to a commercial act and therefore judges should rule.
“The complaint for judicial control is filed to find out whether there is really a need for judicial control for the proper implementation of criminal prosecution. I have given several reasons that may lead a judge to appreciate that a criminal investigation can be conducted in very good circumstances without the need for judicial review. I submitted the documents and highlighted several aspects in the case materials that really prove that at the moment this judicial control does not seem to be appropriate and justified,” lawyer Christian Ene told reporters.
DNA placed Julian Dumitrescu under judicial review on February 1 in a case in which he is being investigated for bribery and forgery, and his sister and her husband are being prosecuted for complicity in bribery and forgery of personal signatures, complicity in bribery and perjury, respectively .
According to the order issued by DNA, Iulian Dumitrescu is subject to several bans, including a ban on his position as president of the Prahova District Council, in which position he would have committed the actions for which a criminal case was brought against him.
Julian Dumitrescu, former president of PNL Prahova and former first vice-president of PNL, is suspected of having, with the help of his brother-in-law Daniel Lambreau, demanded from the businessman, in exchange for 47,500,000 lei, shares that owned by Daniel Lambrea in a commercial company, the value of which is overestimated compared to their real value, in connection with his performance of the duties of the president of the district of Prahova (CJ) and would receive, until December 4, 2023, with the help of 2 accomplices, on the total amount of 16,210,000 lei.
One of the businessman’s companies would have had a contract with CJ Prahova at the time of the lawsuit, and after the acquisition of the commercial company from Lambrea, it would have been awarded a new contract for the performance of works with the beneficiary CJ Prahova.
President CJ Prahov is also suspected of failing to disclose in the three wealth declarations he filled out significant sums of money that would have been spent mainly on foreign trips and luxury items purchased outside the country, a private high school, tennis lessons, rent in an elite residential complex.
