Former DNA prosecutor Christian Ardelean has become the new head of the criminal investigation department of the prosecutor’s office at the Bihor court, Bihoreanul reports.
Such a decision was made on Tuesday by the section for prosecutors of the High Council of Magistracy.
Fired from DNA for pressuring judges
Former journalist Kristian Ardelyan graduated from the National Institute of Magistracy in 2008, on August 1, 2008 he was appointed a trainee prosecutor at the Prosecutor’s Office at the Oradea District Court, and on February 8 as a permanent prosecutor at the Prosecutor’s Office at the Álesd District Court. , 2010, by decree of the President of Romania, from where he transferred on January 1, 2012 to the Prosecutor’s Office at the Court of Bihor, where he was also the spokesperson of the unit.
On January 30, 2019, the CSM Prosecutors’ Section approved a request by DNA interim head Kelin Nistor to recall Ciprian Man and Christian Marius Ardelean as prosecutors at DNA Oradea after recordings showed they were putting pressure on judges.
The Judicial Crimes Investigation Department of the Prosecutor’s Office at the High Court of Cassation and Justice opened a criminal proceeding, the subject of which is the content of the record in Oradea’s DNA, after a denunciation by an NGO, prosecutors ordered the initiation of criminal prosecution in this case.
In addition, several DNA Oradea prosecutors were heard in this case.
The case was opened after lawyer Rezvan Dosianu published an audio recording of the DNA Oradea meeting in January 2018.
The recording refers to the criminal prosecution of some judges with the aim of “instilling fear in them”.
The lawyer claimed to have received the recording anonymously and named those who should have participated in the DNA Oradea meeting, saying he recognized their voices personally. Yes, he nominated Man Cyprian, Muntean Hadrian, Ardelean Cyprian, Pantheus Cosmin as prosecutors.
The argument from the annulment order was declared unconstitutional by the Constitutional Court in a decision issued on November 17, 2023, and as a result, the prosecutor is expected to win the process he initiated to annul the order and even return to DNA, according to Bihoreanul.
Disciplinary action of the judicial inspection
In July 2019, the judicial inspectorate disciplined Cyprian Man and Christian Ardelean, now prosecutors at the Prosecutor’s Office at the Court of Bihor, who appear in an audio recording from DNA Oradea, in which they discuss acts of intimidation of judges.
“It was stated that during the analytical session, which took place in a place accessible to several people, the investigative prosecutors made a series of statements in the presence of other colleagues, which violated the standards of conduct imposed on magistrates. At the same time, the language used by the prosecutors to appeal to some judges of the Oradea Court of Appeal is likely to contradict and cause outrage in public opinion, as it shows their participation in activities that by their nature may raise doubts about the seriousness, independence, impartiality and integrity of the prosecutors “, the judicial inspectorate claimed at the time.
The Division of Prosecutors in Disciplinary Cases rejected the disciplinary process twice, but as many times the Supreme Court of Cassation overturned this decision, ruling that the trial should continue.
