PSD deputy Adrian Alda submitted to the Senate a project that provides that existing cemeteries that are the public property of administrative-territorial units can be transferred, in whole or in part, for free use or to the management of recognized religious cults or cultic units or churches, for their at will, in a situation where they are used only by members of the respective religious cult.

The legislative proposal amends Art. 4 of Law 102/2014 on cemeteries, crematoria and funeral services and complements Art. 28 of the Law 489/2006 on religious freedom and the general regime of cults.

“The cemetery can be in the state or private ownership of the state or administrative-territorial units, in the private ownership of legally recognized religious cults or local cult/church units in the case of confessional cemeteries, in the ownership of business entities, associations or foundations, such as in the ownership of another state, in accordance with the treaties to which Romania is a party”, according to the legislative initiative.

Also, “existing cemeteries that are in the public ownership of administrative-territorial units may be provided in whole or in part for free use or under the management of legally recognized religious cults or local cult/church units, at their request, in a situation in which they are used only by members of the relevant religious cult, in accordance with the provisions of Art. 5 para. (2) and (3) of this law,” the draft of the National Assembly deputy also states.

In motivating the legislative proposal, Adrian Alda states that “at the moment, all cemeteries belonging to administrative-territorial units are only in public ownership, which excessively limits the possibility of entrusting them to the administration or using them by parishes.” “.
