As reported by the court portal, on Thursday the magistrates of the Court decided to stop the criminal proceedings against Mirchi Kosma for committing crimes of bribery (5 essential acts) and abuse of official position (three essential acts) as a result of interference. on the statute of limitations of criminal liability.

The court also decided to stop the proceedings against Vlad Kosma for committing the crime of “abuse of influence” (3 material acts), also in connection with the interference of the statute of limitations of criminal liability.

On the same grounds, the judges stopped the trial against two other defendants in the case – businessman Rezvan Alexe and Daniel Alexandrescu, former director of CJ Prahova.

At the same time, the court decided to confiscate the total sum of more than 10.6 million lei from the accused.

The decision of the Prahova court is not final.

Initially, in November 2016, a three-judge panel of the ÎCCJ issued its first judgment in the case. The former president of CJ Prahova, Mircea Kosma, was sentenced to eight years in prison, and his son, Vlad Kosma, received five years in prison. Also, businessman Rezvan Alexe and former head of CJ Prahova’s heritage department, Daniel Alexandrescu, received two years and six months and six years in prison.

Later, in March 2018, following an appeal, a five-judge panel of the Supreme Court decided to re-examine the case on the grounds that some witnesses had given conflicting testimony in court and there were suspicions related to the way Ploiesti’s DNA tests were conducted by prosecutors. The case was then referred to the Criminal Section of the ÎCCJ.

At the retrial, the trial was postponed several times, some of the judges in the panel were changed, after which in September 2019 the case was sent to the Prahova court, where the case had to be considered from scratch.

On January 20, 2020, the Prahova court returned the case to the Supreme Court, arguing that there is a negative conflict of jurisdiction between this court and the Supreme Court. Later, the High Court of Cassation and Justice finally decided that there was no negative conflict of jurisdiction, and the case was returned to the Prahova court.

On April 11, 2014, DNA prosecutors sent Vlad Kosma and Mircha Kosma, accused of abuse of influence, under judicial control for bribery and abuse of office. Rezvan Alexe was accused of influence peddling and bribery, and Daniel Alexandrescu – of bribery and abuse of office.

According to DNA, in the period 2012-2013, Rezvan Alexe (a relative of the Kosma family) and former deputy Vlad Kosma demanded and received from three representatives of some commercial companies, whistleblowers in the case, a total of 4,410,149 lei, hidden in the opposite value of some works, fictitiously subcontracted by these companies to two companies actually controlled by Alexe.

Prosecutors allege that the sums of money were demanded and received by the two in exchange for the intervention of people with decision-making powers in CJ Prahova, namely Mircea Cosma and Daniel Adrian Alexandrescu (Executive Director of the Heritage Department, subordinate to the Public Procurement and Contracts Service and the Service support of public works) so that the companies receive three works on modernization/maintenance of roads, and also settle with already completed priority works.

Three works are related to the objectives: “Modernization of DJ 101 I Buda Nedelea, Prahova County”, “Works and services related to current maintenance of public roads – compaction” and “Current maintenance of county roads during winter 2012-2013”.

According to DNA, in order for the informants’ companies to win three works, public procurement procedures were carried out in violation of legal provisions at CJ Prahova, with the direct participation of Mircea Cosma and Daniel Alexandrescu, through which the county budget was damaged in the total amount of 6,077,273 lei

According to DNA, the amount was hidden in exchange for some arable land, the object of some certified sales contracts, on the basis of which the company “bought” them from the persons involved by the accused, close to his family, at inflated prices. . In this case, the object of the bribe was the difference between the sale price of the relevant company and the price at which the land was actually purchased earlier, from the first owners, and amounts to 487,000 lei.
