
For all public contracts financed from the budget or EU funds and which have an IT&C component of less than 5 million lei (excluding VAT), it will no longer be necessary to obtain the opinion of the Technical and Economic Committee (CTE) before starting the procurement procedure, according to the Government Decision , published on Friday, September 15, in the Official Gazette.
Under the pretext of reducing bureaucracy in public IT procurement and attracting EU funds for the government cloud, the Çolaku government decided on September 8 to cancel the technical approval required before starting IT procurements worth less than 5 million lei (excluding VAT). , regardless of whether they are financed by state or European funds. Currently, all financial projects that have an IT component with a nominal or cumulative value of more than 2 million lei (without VAT) they needed a technical opinion of the technical and economic committee on the technical specifications related to the feasibility study, technical design and specifications before starting the public procurement procedure.

The regulatory act was announced on September 7 by PSD Digitalization Minister Bohdan Ivan during the business forum of the 3 Seas Initiative.
- “Tomorrow at the meeting of the Government, we will adopt the project of the State Department, which will simplify everything that means state procurement in the field of IT. We will remove more than 50% of all red tape in public procurement to ensure that this European money, more than 1 billion euros in the case of the government cloud, can reach Romania in time,” said the Minister of Digitalization. at the I3M Business Forum.
After the Government passed this act on Friday, the Ministry of Statistics sent out a press release with the main changes, namely:
- changing the composition of the CTE by introducing new institutions, such as the Ministry of Research, Innovation and Digitization and the National Directorate of Cyber Security, for the effective representation in the Committee of institutions/organizations that have powers in the areas affected by the implementation of the CTE, according to the Authority for Digitization of Romania (ADR), powers established by legal provisions.
- the feasibility study is simplified by approving a new form, different from the one provided by GD 907/2016. The new form takes into account the characteristics of projects that have exclusively components of information and communication technologies and for which the preparation of a technical and economic feasibility study is mandatory or necessary, in order to facilitate the efforts of state institutions for the preparation of these documents and to accelerate the development of non-refundable European grants, which are sources of financing such projects.
- the value threshold from which CTE approval for the IT&C component of projects must be obtained before approval has been changed, i.e. increased from 2,000,000 lei to 5,000,00 lei.
- the documentation to be approved by the CTE is also regulated in terms of the new regulations approved for the IT&C field (eg Law 242/2022, GEO 89/2022, HG 112/2023) that relate to the government cloud Platform, interoperability, cyber security.
