Wanted in 2022 for illegal possession of dangerous drugs for personal consumption. The file is closed

In fact, the young man was investigated by DIICOT in February 2022 for the illegal possession of dangerous drugs for personal consumption after he was caught with “0.68g of cannabis for consumption”, writes Libertatea. The prosecutor’s office ordered the criminal investigation to be stopped, and in January 2023 the Bucharest court upheld the decision.

  • “Thus, confirming the detection protocol drawn up on 02.03.2022, the conclusions of the scientific and technical opinion, the judge of the trial chamber establishes that the defendant ##### ##### – #### kept, for the purpose of consumption, 0.68 g of cannabis, an act containing elements of the crime of illegal possession of dangerous narcotics for personal consumption before. art 4 para. 1 of Law No. 143/2000, is punishable by imprisonment for a term of 3 months to 2 years or a fine.
  • Referring to the limits of punishment provided by law, a decision can be made in the case to refuse criminal prosecution, after which the judge will analyze the presence or absence of public interest in the prosecution of the crime, applying the previous criteria. art 318 para. 2 and 3 C.pr.pen..
  • Thus, the consequences that could occur from the point of view of impact on health were reduced, the material element (possession) could not reveal a complex way of committing the act, by means that could indicate a high public danger. Under these conditions, the judge also considers that the efforts of the criminal investigation authorities, necessary for the criminal process, would be disproportionate to the specific severity of the act, and the costs that would be advanced could be directed to the investigation of acts with more serious consequences,” Bucharskyi points out. court in its motivation.

“He realized what he did, he is crying and in shock”

The guy got his driver’s license only three months ago.

After hitting a group of 8 young people on the DN 39 on the way out of the settlement on May 2, he was caught shortly after in Vama Veche. The boy told investigators that he fled the scene of the accident because he thought he had hit an animal, the Observer News reports.

The young man’s lawyer Luminica Popescu told reporters that he admitted to using drugs, but clarified that he is not a drug addict, but got the drugs from Vama Veke, where he went to a party. His defense attorney also stated that the boy had waived his right not to testify and added that he was in a bad state, he realized what he had done and was sorry.

“Later he realized what he had done. He is sorry. He is also not the type of person who circulates on the internet, all that has been written and said is information from certain images. He is not the son of Beizadea, as is said. Parents are not people with money, who have nothing to do with me and allow the child to use drugs, in any form. They are simple, normal people. (…) He admitted that he used drugs. Now we are going to see the one who gave it. This is a much longer story, much more serious, from my point of view, and it remains to be found out what happened,” said the lawyer.

She was asked if his client was using drugs for the first time.

“Yes, as far as I understand, this is not a consumer. He received them at the Old Customs House,” the lawyer claimed.

She added that the boy’s father was not with him at Vama Veche, the boy came there alone, to the party, and did not stay at this resort. The lawyer was also asked if the boy remembered anything about the accident.

“So far, he has overruled his right not to make any statements. He will make a statement on the way. (…) His mood is bad. He realized what he did, I’m sorry, he cries in unison. It was a mistake, he is very sorry, and he will face the consequences. (…) Parents are destroyed. What can you say as a parent in this situation? (…) Father knew that he was going to the Old Customs House, mother did not. The problem is that I wanted to clarify that what was said and written is not true. And it would be fair both for the victims and for him as a defendant if this information was as close to the truth as possible,” the lawyer added.

On Sunday, a court in Mangalia arrested the young man for 30 days, and his lawyer announced that she would not appeal the decision.
