
The joint permanent offices of the Chamber of Deputies and the Senate on Tuesday recalled Daniel Jovanescu from the post of Deputy People’s Advocate on the grounds that his activities will affect the proper functioning of the institution, reports Agerpres.
Daniel Jovanescu worked in the field of prevention of torture and other cruel, inhuman or degrading treatment or punishment and was appointed on 26 October 2022 for a 5-year mandate.
On May 23, the legal committees of the parliament by a majority of votes adopted a positive report on the request of the People’s Advocate Renate Weber for the release of Daniel Jovanescu.
According to Renate Weber’s request, “almost every day the works presented by Daniel Jovanescu are returned with resolutions of the People’s Advocate to correct them so that they comply with the law.”
“The constant attitude of Mr. Deputy Daniel Yovanescu makes cooperation between the People’s Advocate and him impossible, which leads to the emergence of dysfunctions in the institution’s activities. (…) Unfortunately, since his appointment as Deputy People’s Advocate, Mr. Daniel Jovanescu has proven, with documents drawn up or approved as a deputy, violations of the legal framework of the organization and activities that regulate the status of the People’s Advocate, constantly undermining the powers of the People’s Advocate and making his activities vulnerable institutions,” the document states.
Renate Weber accuses him of “disrespect and disobedience” to his decisions
Daniel Jovanescu is accused of “disrespecting and disrespecting the exclusive powers of the People’s Advocate to make decisions”, as well as “subrogation, in violation of the law, of the exclusive powers of the People’s Advocate”.
“Analyzing the request sent by Mrs. Renate Weber regarding the recall of Mr. Daniel Lovanescu from the post of Deputy People’s Advocate, as well as Mr. Daniel Lovanescu’s point of view regarding the points presented in Ms. Renate Weber’s report, the two commissions noted the following: the People’s Advocate institution is headed by a people’s advocate, who in activities are assisted by deputies who specialize in certain areas of activity. Thus, the People’s Advocate is not a collegial body that has the type of sole management, the People’s Advocate heads this institution, and his deputies have the role of assisting him, through their contribution to the coordination of activities in their field of activity, each specializing in one of the six areas of activity, provided for by law,” says the joint report of the legal commissions, adopted on Tuesday by the combined permanent bureaus of the Senate and the Chamber of Deputies.
The same report states that “in the case of deputies, the appointment is made by the permanent offices of the Chamber of Deputies and the Senate on the proposal of the People’s Advocate. Similarly, removal from office should also be carried out by permanent bureaus, on the proposal of the People’s Advocate, since it follows from the economy of the provisions of Law 35/1997, reissued, that the People’s Advocate, through all his powers, which he exercises, for the most part, through deputies, having their assistance, and also because of the powers he has the right to set for deputies, he is in the best position to assess how they carry out their tasks and the level of cooperation they manage to establish at the institutional level, both with the People’s Advocate and with the structures institutions”.
