Six members of the former management of Banyas airport, including two general directors, were finally acquitted by the Court of Appeal of Bucharest after 12 years of trials in the case of violations in the contract for the modernization of the airport, damages of almost 5 million euros. It is one of the oldest DNA files still pending in the courts, and the investigation was conducted when Daniel Morar was head of the department.

After 12 years of trials, judges acquitted six defendants on the grounds that the act did not exist.

It is about Florin Paul Fulger (general director and later technical director of the national company “Aeroportul Internaţional Bucharest Băneasa – Aurel Vlaicu” SA), Liliana Pop (economic director), Dorian Vlasčana (legal advisor), Monika Catalina Tuscher (former head of the State Procurement Department) , Emil Jernoiu (technical director) – accused of abuse of official position, respectively Stefan Mladin (former general director of the airport) – accused of neglect of official duties., reports Agerpres.

In an indictment sent to the court in April 2011, DNA alleged that on February 20 and May 14, 2007, people who held management positions at Benyas Airport (Florin Fulger, Liliana Pop and Dorin Vlascanu) signed two additional documents to the contract for execution of works on repair and modernization of moving surfaces of the airport, contract concluded with SC Romstrade SRL (company owned by Nelu Iordache), leader of ROMSTRADE – UTI – DELTA – TEHNOLOGICA association.

According to DNA, by means of two additional acts, the formula for updating the price of works was changed through a revision formula that does not comply with the legal provisions applicable to this public procurement contract, a formula that was then applied to additional related works for those who first signed the contract. The application of the new calculation formula, which does not correspond to the imperatively regulated formula of the legal review, led to the obligation of the National Company “Aeroportul Internaţional Bucureşti Băneasa – Aurel Vlaicu” SA to pay the executor a total sum of more than 23.6 million lei without any reason.

Thus, DNA noted at the time, damages were caused both to Banyas airport in the amount of 8.4 million lei and to the state budget in the amount of 15.2 million lei.
