According to the project, secretly adopted by the Senate, it is forbidden to use speed measuring devices in vehicles that do not have inscriptions and identification signs, by police officers who do not wear uniforms with inscriptions and identification signs of the traffic police.

Vehicles equipped with radar devices can be used stationary or in motion.

The detection of offenses and the application of sanctions are handled directly by the traffic police, and at checkpoints across the state border by the border police. Detection of violations of the facts of violations of the speed regime is carried out only with the help of authorized and metrologically verified technical means, which is recorded in the violation detection protocol.

Chief Commissioner Alexandru Popa, who represented the Ministry of Internal Affairs at the meeting, stated that the Government’s point of view is negative, arguing that the use of technical means to detect violations of traffic rules is already regulated by the norm of legislative metrology, which shows that in the registration of motor vehicles, it is mandatory the registration number, time and speed of movement must be indicated.

“As far as the legislative proposal is concerned, we appreciate that it is similar to the one that was rejected in committee three weeks ago on the radar advance warning, which was twice ruled unconstitutional,” said the chief traffic police commissioner.

“If we read the reasoning of the Constitutional Court, we are not sure that it is the same as the draft law before us. (…) What do we want? To have as many violators as possible or drive within the legal speed limit? I believe that this option is better to scare those who participate in traffic and drive legally than to trap, catch and punish. Of course, the second option brings certain revenues to the state budget, but it is not certain that it also increases the level of safety on public roads,” said Deputy UDMR Bende Sandor.

AUR deputy Lucian-Florin Puskasu, the initiator of the legislative proposal, said that the idea he started with was to “bring order.”

“We believe that the traffic police should not be outside the law, it should not pursue those who violate the law at any cost, it should do it in a brazen spirit. The law refers to the obligation to register cars that are equipped with registration technology, and we believe that such an attitude is necessary on the part of police agents, considering that we all know the abuses that can be committed in traffic by some agents who feel that they must obtain such trophies at any cost. that the prevention factor is also important in road traffic, and the signaling and pre-signaling of means of fixation and traffic control are in this sense mandatory, I believe that it is useful to be able to teach on the consent of road users, not only because of the excessive application of the law This the meaning for which we initiated this legislative project, and we believe that the Ministry of Internal Affairs should not oppose such practices, as they do not deprive them of their powers, but force them to be much more responsible,” argued the deputy.

The draft law on amendments and additions to Article 109 of the Government’s Emergency Order No. 195/2002 on traffic on public roads with subsequent changes and additions was initiated by 18 deputies from all parliamentary groups and one non-factional deputy.
