
The government at a meeting on Wednesday approved the draft law on the Code of Spatial Planning, Urban Planning and Construction, a regulatory act that will allow the issuance of building permits much faster and with less bureaucracy, Development Minister Ceke Attila said, issuing a term that today in practice can reach a year , will be reduced to 65 days, writes News.ro.
According to Minister Cheke Attil, this is the most important regulatory act in construction in the last 20 years, which optimizes and simplifies the processes of approval, authorization and monitoring in the field of urban planning, land development and construction.
The Minister emphasized: this Code will significantly shorten the terms of approval of urban planning documentation and permission to carry out construction works, so that documentation no longer “walks” from one institution to another.
The normative act shortens the period of approval of PUG and PUZ, as well as the period of development of feasibility studies and creates a national digital platform for issuing urban planning certificates, approvals and construction permits through the national single window of construction, so that there are no more overlaps or contradictions between databases, development strategies, master plans of various institutions, facilitating and simplifying procedures for major investment purposes.

Through the Code, it is also proposed to create a National Register of Buildings – an IT system that will contain data on all permitted constructions, regardless of funding – public or private, including data on the seismic risk of buildings.
“The systematization of legislation and the establishment of new concepts, in the form of a complex, coherent and stable legislative framework, will lead to the improvement of the quality of the anthropogenic environment, the provision of the constitutional right to a healthy environment, the balance between general and individual interest, balanced and sustainable development, stability and predictability of the investment environment and, implicitly, economic competitiveness,” the Ministry of Development states.
In rural areas, it will be possible to build single-family houses for personal use, basement floor, without basement, with an area of 150 square meters, according to own projects prepared by specialists or typical projects provided by local authorities, only with the notification of the city hall. It will also be possible to close balconies in blocks, build garages, covered terraces, pergolas or summer kitchens with the notification of the city hall and without a building permit.
Stricter rules for unauthorized construction
In order to prevent work without a construction permit, a permit for regular registration is introduced, which requires the construction to comply with all current regulations and the appropriate approval of the documentation. In addition, the regularization procedure is taxed ten times higher than the existing one, which provides an important benefit for the local budget.
In order to ensure a controlled quality of the construction market, construction companies will undergo certification, and those that do not confirm compliance with the necessary technical and administrative requirements cannot participate in auctions in which they are not certified. For example, a company that does not have the necessary specialists for the certification of works in the sanitary field will not be able to participate in tenders for the reconstruction or construction of hospitals, said the Minister of Development.
The regulatory act also proposes to introduce a tax on the construction of large buildings (more than 500 housing units), which will be paid to the local budget, with a clearly defined purpose for construction, road, sanitary, and educational infrastructure. “In this way, we will no longer have entire neighborhoods built haphazardly, without building and road infrastructure or without medical offices, crèches, kindergartens and schools – necessary functions for a healthy and balanced life, and parents will no longer have to travel by the dozens. kilometers to take their children to school,” Cheke Attila emphasized.
