The lawsuit was discussed in October last year and was partially accepted, as the 29th Tripartite Administrative Court of First Instance of Athens recognized the obligation of the state to pay five family members a total of 300,000 euros in compensation for mental suffering caused by the death of their relative.

On February 10, while the criminal investigation into the fatal fire that claimed the lives of 102 people is ongoing, the state appealed the decision of the Administrative Court of First Instance. Lawyers involved in the case note that this is an atypical legal move with the aim of simply retaining the state’s right to appeal in the hope of a compromise (as happened, for example, in the case of the murder of Alexandros Grigoropoulos). But, on the contrary, for a 25-page document, by which the state essentially seeks to cancel the decision of the first instance, limiting the amount of compensation, it will eventually be called upon to pay the victims of the fire.

In the arguments put forward by the state, it is significant that the absence of a recommendation on the organized evacuation of citizens by the fire department is “causally” not related to the death of 102 citizens from a fire. The appeal also states that the forecast of the National Meteorological Service (EMY) in the direction and strength of the wind changed sharply and abruptly from 16:45 to 20:00. (time of the start of the fire) and that due to the wind, the effectiveness of air assets was nullified. An argument is also put forward that there was no proper landscaping in the affected areas, as well as that the inhabitants did not clear their properties of branches, dry grass, etc. which is at the disposal of “K”.
