The FDA’s rationale, released yesterday, details the timing of an audit attempt at Intellexa and impediments to the company’s operations at various stages. On September 15, 2022, the inspection team went to the address of Intellexa in Chalandri, as stated in its charter. However, it turned out that another company had been established in the same area to provide accounting services to Intellexa. This was followed by communication with Intellexa’s lawyer and legal adviser, and it was decided to conduct a new audit at its facilities in Elliniko. However, on October 3, another echelon discovered that the company’s three-story Elliniko building was “completely empty and without a functioning network infrastructure or information system.”

The Office for the Protection of Personal Data has determined that the company is not cooperating properly and is postponing the current review.

The Office first requested oral and then written responses to a number of questions. However, as noted in the decision imposing the fine, Intellexa was “excessively slow in responding to the Office’s questions and responded after repeated reminders from the audit team and after more than 40 days, only after receiving a subpoena.” In addition, despite complaints, the company did not provide the FDA with financial and contract data in relation to its operations, citing data it had already provided to the FDA. However, the Office for the Protection of Personal Data indicates that the data provided by EAD concerned a limited period of time and only concerned the relationship of public services with the company. Intellexa justified the delay, explaining it by “objective difficulties that exist due to the inactivity of the company and the lack of human resources.”

Just last month, and while news of the first confirmed illegal surveillance in Greece using Predator software has been around since April, the Electronic Crime Prosecutor’s Office ordered the prosecutor’s office to search the offices and homes of companies and individuals allegedly linked to the case. Then one of the stairs was found in one of the raids in a room that had been vacated a few days ago and construction work was underway.
