
The head of ANAF, Lucian Heiush, announced on Digi24 on Sunday that he will be able to say in two weeks at the most whether he should pay a solidarity contribution to the Romanian state in the OMV case. He argued that for ANAF all companies are equal and that the tax office will carry out very strict and very thorough checks with the help of the specialists it has on all companies that should be subject to Regulation 186/2022 and if they try to do “this well-known financial engineers, will not be able to escape.”
“We as ANAF can only do one thing and we will do it extremely tough starting tomorrow, we will check not only OMV but all the companies that fall under the provisions of this Decree and from the first checks let’s see, or their turnover, 75% represent the CAEN codes clearly indicated in the Regulation. The final checks cannot be done in the following days, as the financial statements in Romania are completed and submitted on May 30th, but with a 99.9% probability in two weeks at the most, I will be able to say whether or not this joint contribution is due in the case of OMV. He clarified that ANAF will check “as they calculated and believed that the turnover in 2022 is not subject to this Decree”.
“OMV Petrom is a Romanian company, the only connection with OMV from Austria is that it owns 51.15% of OMV Oetrem and dividends will be transferred according to this percentage, for the rest there is no connection between its activities in Romania. and that they have to pay taxes here, activities in Austria and pay tax in Austria, because there may be other conditions,” explained the head of ANAF.
Lucian Gayush: “For us, all companies are equal. If they try to do financial engineering, I guarantee you they won’t be able to get away.”
In the event that OMV or another company does not comply with this provision regarding the solidarity tax, ANAF will file a tax return and begin foreclosure of this company in order to collect the funds owed to the budget, he said.
“For us, all companies are equal, and we’re going to do these very strict and very detailed checks with the experts that we have on all the companies that should be covered (under the provisions of the Decree, no), and not one will get away without paying this contribution. . OMV Petrom, the largest integrated energy company in Southeast Europe, announced on Thursday that it does not plan to pay the solidarity tax for the fiscal year 2022, established by the Government’s Emergency Ordinance no. 186, published on December 29, 2022, which states that it has “less than 75% of its turnover from the specified sectors: crude oil production, natural gas production, oil production and production of refined products”.
