
DNA informed the Constanța court of the first PNRR fraud case closed by anti-corruption prosecutors, involving the owner of a design firm accused of submitting false documents to obtain a contract to build a hospital in Constanța, Agerpres reports.
DNA prosecutors ordered to submit to the court Constanța a plea agreement entered into with the businessman for the crimes of illegal receipt of funds and improper participation (in the form of incitement) in the attempt to use or provide false, inaccurate or false documents or statements or incomplete, if the act leads to illegal and false receipt of European funds in documents with a personal signature, in a continuous form.
In the press release published on Friday, DNA did not mention his name, but according to the judicial portal and the local press, he is businessman Victor Alexandru Chobotaru, the majority partner of Atlas Consulting&Proiect SRL, the leader of the association of companies that won the development contract economic technical documentation for the project “Construction and assistance to the municipal polyclinic hospital” in Constanta.
According to DNA, during 2021, in the context of the organization of the Constanta City Hall, an auction for the purchase of services for the preparation of technical and economic documentation related to the investment goal “Construction and assistance to the municipal polyclinic hospital named after ” funded through the National Recovery and Resilience Plan, the businessman allegedly submitted several false documents.

With the beginning of the second stage, that is, the technical and economic feasibility study and the submission of documentation for obtaining approvals and approvals required by the urban planning certificate, dysfunctions would arise in the execution of the contract, on this occasion representatives of the city hall found out that none of the partners, except for the entrepreneur, knew about signing the contract for the provision of services, and also did not participate in the preparation of the feasibility study.
These aspects prompted the employees of the City Hall of Constanta to file a criminal case against the winning company and its legal representatives.
During the investigation, Viktor Aleksandru Chobotaru admitted his guilt before DNA prosecutors and agreed to receive a sentence of one year and eight months of imprisonment with a suspended sentence for a period of 2 years of supervision and a ban on certain rights.
However, this agreement must be approved by a judge at the Court of Constanta.
He also paid part of the damage caused to the local budget of the municipality of Konstanz, totaling 600,000 lei.
