Prosecutors at the Prosecutor’s Office at the Court of Appeal in Bucharest have opened an investigation into the plane crash on Saturday afternoon in Giurgiu County, which killed two people, News.ro reports.

The Prosecutor’s Office at the Court of Appeal in Bucharest announced on Saturday evening through a press release that prosecutors have opened a criminal investigation into the Giurgiu plane crash.

“This is how a small plane was identified that crashed in the forest in Letka Noue commune, Giurgi County, the victims of which are a woman and a man. Official investigations are being conducted in the case on the grounds of prior crimes. art 112 and Art. 116 para. 1 liter a, b, c both refer to art. 122 and Art. 114 para. 1, 2 and 3 and Art. 115 para. 1 of Law No. 21/2020 on the New Air Code of Romania, Art. 192 para. 1, 2 and 3 of the Criminal Code,” reads the press release of the Prosecutor’s Office of the Bucharest Court of Appeal.

Article 112 of the New Air Code of Romania provides that “violation by civil aviation personnel of official duties provided for by regulatory acts having the force of law, or failure to comply with them, if this action endangered the safety of the flight aircraft, causing damage or causing damage rights or legal interests of an individual or legal entity, shall be punished by deprivation of liberty for a term of 2 to 7 years with deprivation of certain rights.”

Also, in parts 1, 2 of Article 114 of the same regulatory act, it is stated that “the performance of official duties by aviation personnel while intoxicated is a crime and is punishable by imprisonment for a term of 6 months to 3 years or fine; the performance of official duties by aviation personnel who have a blood alcohol concentration of more than 0.80 g/l of pure alcohol or are under the influence of psychoactive substances shall be punished by imprisonment for a term of one to five years with the deprivation of certain rights.”

At the same time, Part 1 of Article 115 stipulates that “piloting an aircraft by a person who does not have the certificate documents provided for by the current rules for piloting the corresponding aircraft is punishable by imprisonment for a term of one to five years.”
