According to the SYRIZA-PS deputies, the decisions of the Council of Europe of 2022 canceled the acts, according to which the controlling stake in the amount of 50% plus one share of the authorized capital, owned by the Greek state in EYDAP and EYATH, was transferred to Hellenic Holdings. and real estate company S.A. In addition, this transfer was carried out with a strong deviation from Article 2 of Law 4425/2016, which provided for the obligations arising from the Constitution and the obligation to comply with judicial decisions.

They claim that the government, through the provisions of articles 114-115 of Law 4964/2022, in July 2022 tried to circumvent decisions no. 190 and 191/2022 of the Plenary of the Council of Europe, five months after their publication and at a time when he was fully aware of them.

“He decided to keep the shares of EYDAP SA and EYATH SA in the Superfund and introduced provisions on the non-transferability and non-confiscation of the shares of the companies in question and the strengthening of the role of the EESP General Assembly, as well as the legalization of acts and decisions of EYDAP and the EYATH Company that were taken after the transfer of shares of these companies from the state to EESYP, as well as the actions and decisions of this company regarding the administration and management of the companies EYATH and EYATH”, state and contrast that SYRIZA-P.S. filed an objection of unconstitutionality at the time, in which Giorgos Katrugalos stressed that: “This is one of the rare cases where a legislative norm violates not only the Constitution, but also the annulment of the decisions of the Council of State.” which are recent, which are clear and leave no room for doubt.”

“A few days ago, the decisions of the Council of State were published in which it ruled that the executive and legislative branches, with articles 114 and 115 of Law 4964/2022, do not comply with the decisions of the State Council 190 and 191. /2022, according to which the transfer of shares of EYDAP and EYATH from the state to the Superfund was declared unconstitutional. Subsequently, the Council of Europe orders the Ministry of Finance to take all necessary measures no later than within six months to return the shares of EYDAP and EYATH to the state.

In accordance with Law 5037/2023, which was adopted a few days ago, the formulation of water policy and the supervision of water supply and sewerage service providers are removed from the state and transferred to the responsibility of the regulatory body. The government’s choice has heightened the concern of citizens and academia, as it loses the character of water as a public good and opens the back door to privatization.

The control of EYDAP SA is provided for by the constitution. and EYATH SA by the Greek state, not only through their supervision, but also through their share capital. Establishing the return of shares in EYDAP SA and EYATH SA to the state becomes necessary in order to prevent any attempts to privatize them,” notes K.O. of the official opposition party, and also emphasizes that, in accordance with the proposed agreement, the shares of EYDAP SA are transferred to the state. and EVATS S. A. Hellenic Holdings and Property Company SA (EESYP SA) is SUPERFUND and thus ensures direct state control over EYDAP SA and EVAT S.A. and the provisions of Articles 114 and 115 of Law 4964/2022 are repealed.
