
Anti-Bullying Day: In 2019, UNESCO declared the first Thursday of November every year as the “International Day Against Violence and Bullying at School, including Cyberbullying” (International day against school violence and bullying, including cyberbullying). Thus, it is recognized that school violence in all its forms is a violation of the rights of children and adolescents to education, health and well-being.
As it is difficult for me to ignore what is happening in many of our schools, I have made this public accusation with the express desire to draw attention to our lack of accountability. In all.
1 Intimidationis a conflict created by a student with consequences humiliating for another student, and it happens repeatedly in front of other students. It has always been there, but in recent years it has intensified against the background of general non-compliance with the rules in schools. A recent study in this field shows that: 25% of students are aggressors, 50% are victims and 80% are witnesses jeerwith
2 The Internet is full of books and studies about this phenomenon. There is almost no school where anti-jeer or that does not boast any presentations or research on the subject on the web. The numbers show us harsh reality: unnecessary rules and unsustainable programs.
3 Confusion between school violence and jeer it is incredibly:
- Today, almost everything related to bullying in school is qualified as “jeer”, is considered something that is ultimately not that serious and can therefore be overlooked;
- The confusion is so great that even the methodological norms of anti-jeer contains the phrase “zero tolerance school in violence“;
- 1 in 7 children are physically abused in middle school and 1 in 10 in high school. None of these cases are reported to the DGASPC, although this legal obligation has been in place since 2004;
- Some think so jeer when a student is attacked by a teacher – no, this is a crime of offensive behavior;
- Others think that’s all jeer when a student attacks a teacher – no, this is a civil offense when the child is under 14 years old; and this is a crime when the aggression is physical and the child is over 14 years old.
4 This state of affairs was caused by a constant decrease authority of teachers: some cannot captivate or even interest the students, they have no vocation to study and come to school as a simple job where they receive a salary.
5 Decline contributed to the decrease in the authority of teachers in accordance their parents owed them. They suddenly became know-it-alls, fierce critics of teaching methods, analysts of school textbooks.
6 We have legislation modern and almost sufficient. However, teachers do not know and do not understand this, do not discuss it seriously with students, do not interest parents:
- Not a single teacher in Romania has heard of the 2004 Law on the Rights of the Child. No one knows what legal responsibility they have for the minors they teach;
- No teacher in Romania has read in the 2011 Civil Code about his financial responsibility for the actions of his students and how he can take action against the child and his parents if he is insulted on Facebook or Instagram;
- The Education Act 2011 is too thick and too technical. Nobody has time to read it and it’s too hard to understand;
- The status of a student in 2016 is ridiculed by teachers, even hidden in some school divisions, students refer only to rights (especially when it comes to uniforms and leaving school by older students) and are completely unknown to parents;
- The framework for the organization and activities of pre-university education units, published two months ago, is a document containing 200 articles, too technical to be easily understood by adults, let alone children;
- Parliament was wrong when it thought it was solving the problem by legislating a so-called social phenomenon jeer, which he turned, thus, into a legal phenomenon. The 2019 law has not yet taken effect;
- In 2020, regulations issued by the Ministry of Education were needed. Many educators and psychologists were invited to write/approve these norms, but no lawyer specialized in working with minors;
- Hundreds of programs have been developed on this topic at the level of schools or non-governmental organizations jeerwith Almost all of them contain conceptual errors and still did not produce visible and lasting results. But the projects were ticked off, the reports were completed and the money was spent.
7 I say this legislation almost enough because, for example:
– the mark of bad behavior that accompanies the main sanction is no longer a sanction because after several weeks of good behavior it is removed from the student’s file;
– the cancellation, which took place two months ago, of the possibility of expelling high school students for very serious actions will only contribute to indiscipline in schools;
– the legal regulation of students’ disciplinary responsibility is a legal joke: sanctions are provided at the level of the student’s status, not at the level of the law, disciplinary violations are not directly listed, and the investigation procedure to establish the violation simply does not exist. In fact, there are many teachers who say that you cannot take an application from a student in the absence of a parent – which is legally wrong! Taking this line of reasoning further, many have come to the conclusion that the police cannot police children for guns or drugs except in the presence of parents or teachers – which is ridiculous!
8 It is extremely serious that teachers cannot determine at present action that can be included in what we call jeer. I have often been in classes and seen a child ask something or answer something in what we would call “nonsense”, at which the whole class, led by the teacher, laughs, not understanding what exactly happened: jeer frankly. And this is the lightest form, generally bearable, unfortunately.
9 anti-jeer and against violence from schools overlap, get confused in tasks and still only on paper. No one at school knows they exist, no one knows who or how to contact them, and no one knows what skills they possess. Obviously, the rules in this sense are not public either inside the school or on the school website. There are no public reports on their activities.
10 Without this workable structure, when they have conflicts among themselves, students find themselves in a situation to give one’s own justice. Except that now there are situations where even white weapons are used.
11 Tolerance jeercreates a sense of insecurity and breeds indiscipline that has increasingly serious consequences. The first consequence regarding usingcellphone:
- There is no student who does not have a phone at school. There are countries where a minor cannot own a phone in order to prosecute the adult who gave it to them. We do not have such a regulation. On the other hand, Romanian legislation does not allow parents to check the content of messages of children over 14 years old; school teachers or center educators cannot check telephone communication without the student’s consent;
- It ends with young students being humiliated by seniors, forcing them to kneel in front of them and their colleagues, beating them in public or abusing them in toilets, actions that they film and upload to YouTube;
- Although minors under the age of 13 cannot have an account on social networks without their parents’ consent, in Romania there are young children who have falsified their date of birth and opened accounts on FB, Insta, TikTok, SnapChat without their parents should know or be interested in these matters;
- Some students open social media accounts in the name of classmates and even teachers to make fun of them. No one knows of a legal way to stop it, and the police are so overwhelmed with situations that they prefer not to receive or disclose such reports;
- Altering photographs of minors in sexual poses is a crime of child pornography. Courts are dealing with an explosion of blackmailing of minors with such images of friends, lovers or strangers. No one cares that the mere possession of such images is a crime;
- No one knows what is allowed in terms of taking pictures at school, what is not, how to legally ban a student from using a cell phone during class, or if they can be banned from using it at recess. Although they have the legal leverage to do so, teachers do not know how to act;
- Many minors post their photos OnlyFans, although it is illegal where they get their income from. Colleagues know them, teachers know them, but no one reports on these cases;
- Now almost all teenagers are enrolled in dark web. Romanian adults don’t even know what it is.
12 The second consequence concerns goods that students bring to school although they are prohibited – lighters, pain reliever spray, cigarettes, knives, lighters, alcohol:
- Possession A MATCH students in the school premises perceive it so normally that no one raises the question that it has been banned since 2016;
- Affairs of white weapon brought to school are not reported to the principal (bringing to school is a disciplinary offense provided for by the Students’ Charter) or to the prosecutor (bringing to school is a crime provided for by the Criminal Code);
- It may seem funny that the principals were running around the school yard with a fire extinguisher after the students. The tragedy is that students smoking no problem in the school toilet, at the end of the sports field or on the sidewalk in front of the school. Sometimes students smoke in the same place as teachers, they don’t even have anything to hide from each other;
- camps with students, coming-of-age or graduation parties are places where the use of alcohol, if not marijuana, is acceptable for everyone;
- Commercial agents who sell alcohol and cigarettes to minors, nothing happens to them. In Romania, the law cited in this sense is not only not applied, but also laughed at: only no one goes to the store with a ticket.
