Autonomous public bodies such as ASF, ANRE and ANCOM will be able, under certain conditions, to increase the number of management positions from 8% to a maximum of 10% of the total number of employees, according to the deviation approved by the government from Thursday to law 296/2023 (with new fees and taxes). “This increase in the share of management positions to 10% is not a given. There are two cumulative conditions that must be observed,” said Minister of Finance Marcel Bolosh.

What relief have ASF, ANRE and ANCOM received in the GEO approved by the Government on Thursday

On Thursday, the Government adopted an extraordinary resolution to amend some fiscal and budgetary measures introduced by Law 296/2023, and one of them concerns state regulatory bodies subordinate to the Parliament, which are self-financed through fees and taxes imposed on economic sectors from who controls them.

These include the Financial Supervisory Authority (ASF), the Communications Regulatory Authority (ANCOM) and the Energy Regulatory Authority (ANRE).

What is the provision of the order adopted by the Government on Thursday:

“Departing from the provisions of Art. XLVII paragraph (5) of Law No. 296/2023 on certain fiscal and budgetary measures to ensure the financial stability of Romania in the long term, with the following amendments and additions, in the case of autonomous state bodies/agencies/institutions, the Government of Romania may approve by memorandum the total number of management positions , which exceeds 8%, but does not exceed 10% of the total number of approved positions, if the following conditions are met:

  • a) the body/institution/institution has been reorganized or is about to be reorganized as a result of the implementation of the provisions of Law No. 296/2023 with further amendments and additions before the date of entry into force of this emergency order;
  • b) after the entry into force of Law No. 296/2023 with the following amendments and additions, the body/department/institution received additional powers regarding the implementation of some provisions of European legislation”

The memorandum is initiated by the concerned autonomous government body/agency/institution and approved by the Ministry of Finance.

The deadline provided by Law 296/2023 for the reorganization, which must be done by all public institutions, is June 30, 2024.
