
Homeowners associations have serious problems with electronic billing compliance. During a conference with representatives of ANAF, an elderly woman, a representative of the association, wanted to understand something about e-Invoice, especially since on different days she received different answers when she visited one of the institution’s offices.
“I am a representative of the owners’ association. This e-invoicing issue is beyond belief. According to the legislation, the HOA is non-profit. What is she looking for in an electronic bill? What is she doing there? This creates some costs: a digital certificate, an Internet subscription, a computer, a printer, all consumables and a person who takes care of all this work,” she said at an event organized by FACIAS.
The HOA, says the lady, receives only invoices from suppliers: it pays for water, garbage, electricity and everything else.
“The association does not issue invoices. Even those who have antennas or rented premises, that money, also by law, they are obliged to use for repairs. They are prohibited from using them for purposes other than their intended purpose. They don’t make a profit,” she explained.
He also stated that he was in a very bad situation because “I personally went to ANAF 3 times and no one could explain to me.”
She also said she got 3 different answers:
1. It is mandatory
2. The HOA and the administrator have nothing to look for
3. By introducing an e-invoice, we eliminate evasion
“The owners’ association has nothing to shy away from. Let’s go a little lower. Each lei in the owners’ association means the tenant’s pocket. Despite this, spending this winter has reached incredible levels. Hearing what we had to do, everyone jumped up. Let’s get into the crowd a little bit, she said.
The representative of ANAF says that the decision should be made by the Ministry of Finance
“I know that there are requests sent by the owners’ associations to the Ministry of Finance, and we at ANAF also have requests in this regard. I can tell you that, indeed, you are not exempt now. It appears because there are also situations when the accounts are exhibited by owners’ associations. There are things that are rented, etc.,” answered Mihaela Dragulin, director general of ANAF’s General Directorate of Taxpayer Assistance.
He also noted that the mentioned aspects were sent to ANAF “colleagues in the ministry”.
“Housing associations have already submitted 112 applications in terms of digital certificates. You already have a digital certificate. From the point of view of commitment, there is another discussion: we also appealed to the Ministry of Finance. It remains to be seen how this will work out“, Dragulin concluded.
