From January 1, 2024, VAT on a number of goods and services has increased. Thus, VAT also increases in the case of ecological, traditional and mountain products. The problem is that since we are still talking about food, tax officials believed that VAT would increase from 5% to 9%. Well, it turns out no, it went up to 19%. At least this is how the Main Regional Office of Public Finance (DRFP) from Brasov and Galats interprets.

The Chamber of Fiscal Consultants (CCF) believes that the two finance departments have misinterpreted the legislation and has sought clarification from the Ministry of Finance that VAT should be 9% even though it is food.

“Since, in our opinion, the understanding of these tax authorities is erroneous and misleads taxpayers as well, we request that measures be taken to publicly refute the relevant information,” the document sent to the agency reads.

As a reminder, due to the Law on the increase of taxes (L296/2023) and the introduction of new VAT from January 1, 2024, there has been an increase on a number of goods and services, in addition to what I have said above.

• VAT has been increased from 9% to 19% on the supply of non-alcoholic beer and food products with added sugar, the total sugar content of which is at least 10 g/100 g of product.

Milk powder for newborns, babies and young children, cakes and cookies are excluded.

It increased from 5% to 9% for:

• provision of social housing

• delivery of houses with a usable area of ​​no more than 120 square meters.

• delivery and installation of photovoltaic panels, solar panels, heat pumps and other highly efficient heating systems

• services consisting of providing access to amusement parks, amusement parks and leisure parks, fairs, exhibitions, cinemas and cultural events, other than tax-exempt

VAT for gyms has been increased from 5% to 19%.
