
Law 296/2023 and Order on trains (115/2023) caused confusion among specialists regarding the period during which fines for e-Invoice are not accrued.
Minister of Finance Marcel Bolosh reminded that reporting is mandatory.
“This is within 5 days from the moment the bill is issued. The system is optional until June 30. Therefore, from July 1, the e-Invoice module is mandatory. From January 1 to April 1, the fine is not charged. We are walking towards each other. We are not absurd in using the module,” Bolosh said.
The representative of the Ministry of Finance gave details on this matter:
“Regulations on establishing a fine for non-compliance with the deadline of 5 working days from the date of issue of reporting accounts, this fine was stipulated by Law 296/2023. OUG 115/2023 did not interfere with this provision. The confusion was probably created by setting a somewhat similar deadline of 5 calendar days for the transfer of bills in the system, starting on July 1, 2024, and setting a penalty for failure to meet this deadline, similar to those currently established by Law 296 for this reporting period. she explained.
