Vodafone and E.ON Romania have sent notices to other legal entities (other companies) informing them that from January 1, 2024, they cannot issue their invoices in the e-Invoice system, but in the traditional system.

It seems that they do not understand about the electronic invoice, which is what Law 296/2023 is about: from January 1, 2024, the obligation is only to transfer it in the system. This is not send-receive. The latter, theoretically, will happen from July 1, 2024. There is still time until then. Let’s see how the system will cope.

Therefore, the traditional format will continue until July 1, 2024, only they must be submitted in the Ministry of Finance system in parallel.

The deadline for submission in the e-Invoice system is 5 calendar days from the moment of invoicing, but no later than 5 calendar days compared to the deadline for invoicing provided by the Fiscal Code, i.e. the 15th of the following month.

If you do not declare, it is considered a violation and is punishable by a fine of 5,000 lei to 10,000 lei for legal entities classified as high tax payers.

The average ones will receive a fine from 2,500 to 5,000 lei.

Other taxpayers, i.e. lower than average, will receive a fine of 1,000 to 2,500 lei.

What E.ON says in the message sent to other companies

“In connection with the latest regulations on the administration, operation and implementation of the national system of RO electronic accounts in Romania, which derive from the provisions of Law 296/2023 and GEO 115/2023, please keep in mind that in the period 01.01.2024 – 06.30. 2024 E.ON Romania SA will register and pay the invoices received in the traditional format.

This information does not affect your company’s obligation to upload invoices to the national RO eFactura system arising from legislative changes.

As a result, we ask that between 01/01/2024 and 06/30/2024 you send us invoices in the traditional format, the same as before the date of this information, to the email addresses that your company uses for E. ON. Romania SA”

As a reminder, Vodafone Romania also sent a similar message.
