
The Bucharest Court of Appeal decided on Thursday to reject Euroins’ request to suspend the ASF’s decision to revoke its operating permit. If the court ruled in his favor, Euroins could immediately resume business and start reselling RCA insurance.
- “Briefly about the solution: Rejects the request for suspension as unfounded. With an appeal within 5 days of notification, the appeal must be submitted to the Bucharest Court of Appeal. It was decided on 04/27/2023 by providing the parties with a decision through the court registry.”, This is stated in the decision of the Court of Appeal of Bucharest.
Through the court, Euroins requested the suspension and cancellation of the decision of the ASF
Euroins Romania and the Bulgarian group Eurohold have launched a legal action to challenge the decision of the Financial Supervisory Authority (ASF) dated 17 March 2023, by which the insurance arbitrator revoked the authorization to carry out its activities and declared it insolvent.
In this regard, “Euroins” started 2 processes: one regarding the suspension of the decision on ASF and the other regarding the cancellation of the decision on ASF.
Both are open at the Court of Appeal in Bucharest, which ruled today, April 27, on the request to suspend the ASF decision.
The Bucharest Court of Appeal has not yet set a trial date for the case in which Euroins is seeking to overturn the ASF decision.
Injured parties and clients of Euroins have sent more than 30,500 appeals to the Insurance Guarantee Fund (FGA) for damages or premium refunds, but by April 3, the Fund had officially registered just over 10,100 such appeals.
