The provisions of the Community Directive have been incorporated into our national law with the Hatsidakis Labor Law (4808/2021), making Greek law now more favorable than European law in some places.
According to the information, the reasoned opinion concerns technical issues related to the application of the directive in question to seafarers, for whom the institutional framework is at the stage of completion. In fact, the relevant presidential decree has already been signed by the co-ruler ministers. In particular, law 4808/2021 on “Protection of labor”, as clarified in yesterday’s circular, provides for 14 days of leave for fathers of children born on or after 19 June 2021 (the date of its publication in the Official Gazette), parental leave, the right to absence due to force majeure, flexible working arrangements for parents and extension of the series of holidays to which mothers are entitled in the event of adoption. The circular also includes provisions for protection against dismissal of parents who have requested or received such leave.
The following new licenses have been introduced or renewed:
• paternity leave 14 days with pay. It is granted in whole or in part at the request of the employee as follows: a) the employee receives two days of leave before the expected date of delivery to cover the needs associated with pregnancy and childbirth, in which case the remaining 12 days are provided, in whole or in part, directly in connection with the birth of a child , within 30 days of the birthday, or b) the total number of vacation days after the birthday was granted. Maternity leave under the previous regime was two days. Those fathers who have received two days of leave are entitled to additional days before the expiration of one month from the date of the child’s birth.
Fathers of children born after June 19, 2021 can receive paternity leave.
• Childcare leave 4 months. Provided permanently or in parts for both parents with a supplement from UAED for the first two months minimal salary. The only condition is that the employee has worked for the same employer for one year. In case of adoption or adoption of a child under the age of eight years, parental leave is granted from the moment of his entry into the family.
• Guardian license. This unpaid leave is provided to meet the needs or care of relatives or others living in the same household for a serious medical reason.
• The right of absence of a parent or guardian is established up to two times a year with pay, for one day each time and for reasons of force majeure (eg illness).
• Parents of children under the age of 12 and caregivers have the right to request remote work, flexible work or part-time work, provided they have worked for six months with the same employer.
• Allowing working women to use assisted reproductive methods.
