The father of a newborn child who is an employee receives parental leave of 10 working days, practically extended by 5 days, according to GEO 117/2022. According to fiscal consultant Adrian Benzi, this regulation wants to ensure the effective participation of the father in the care of the newborn child in order to combine professional and family life.

“In addition to persons employed on the basis of labor or service relations, persons who carry out activities on the basis of legal acts that allow the performance of work, such as labor contracts in cooperatives, assignment contracts within companies, have the right to parental leave for shares, sports contracts activities or management contracts concluded in accordance with the legislation listed in this order,” says Benza.

Compensation for parental leave is paid by the employer and is equal to the salary for the relevant period. The period of parental leave is included in the length of service.

A father who is in the temporary status of a military serviceman has the right to leave for 10 working days in connection with the birth of his own child under the terms of this order.

If the father of a newborn child also received a certificate of completion of childcare courses, the duration of childcare leave is increased by 5 working days.

The employer is obliged to approve parental leave and inform employees about this legal right. While the employee is on parental leave, the employer is prohibited from issuing an order to stop reporting work.

For failure to comply with these legal norms, the legislator also provides contra-conventional sanctions.

The Government is obliged to adopt methodological rules of application within 30 days from the date of entry into force of this order.
