
A pilot project for monitoring with electronic bracelets of aggressors under judicial control or under house arrest will start in the first phase, starting this year, in Bucharest, Iasi, Mures and Vranci, and in this phase alone the police will need more than 47 new officers and another 604 agents, according to the draft GD on the government’s agenda on Wednesday.
The executive power wants to adopt on Wednesday the draft Decision on the technical and organizational aspects of the operation of the pilot system, as well as on the implementation of the electronic monitoring information system (SIME).
Law providing for electronic monitoring within the framework of judicial and criminal enforcement procedures, announced last May by President Yohannisprovides that aggressors under judicial control, house arrest or restraining orders can be monitored using electronic bracelets that track their movements via GPS.
According to Law 146/2021, in the first phase, in a pilot system, electronic monitoring is applied to cases in which there are protective orders to prevent and combat domestic violence, starting from October 1, 2022 to December 31, 2025 in the last .
Electronic monitoring of aggressors: the first countries where it will be introduced
The act before the government on Wednesday will regulate, among other things:
- a) technical and organizational aspects regarding the operation of the SIME pilot system;
- b) SIME implementation aspects;
- c) the conditions under which a person may be required by law to wear an electronic monitoring device while operating a SIME pilot system.
Electronic monitoring in the pilot system must be applied during the period established by Art. 40 paragraph (1) of Law no. 146/2021, in three stages, defined with reference to the cases of application and the territorial area in which the system is to be implemented, namely:
- a) the first stage – in the period 2022 – 2023 – at the level of the municipality of Bucharest and the counties of Iasi, Mures and Vranca;
- b) the second stage – in 2024 – at the level of the administrative-territorial units provided for in years a) also at the level of the counties of Bacau, Brasov, Karash-Severin, Kalarasi, Cluj, Covasna, Galati, Giurgiu, Harghita, Ilfov, Mehedinci, Neamts, Prahova, Sibiu, Satu Mare, Salai, Teleorman, Vaslui and Vilcha;
- c) the third stage – in 2025 – at the level of the administrative-territorial units provided for in years a) and b) and at the level of the counties of Alba, Arad, Argesh, Bihor, Bistrita-Neseud, Botosani, Braila, Buzeu, Constanta, Dambovitsa, Dolj, Gorzh, Hunedoara , Ialomica, Maramures, Olt, Suceava, Timis and Tulcea.
“The criteria underlying the application of electronic monitoring in the pilot system in the first stage at the level of the municipality of Bucharest and the counties of Iasi, Mures and Vranca are represented by the volume of case studies in this field registered at the level of the municipality of Bucharest, the need to analyze the mode of operation of electronic devices in hard-to-reach districts – rural/mountainous/hilly/depressed and border areas, as well as fluctuations of people registered at the level of these administrative-territorial units.
And the last, but no less important, at the level of the listed administrative-territorial units is the possibility of introducing monitoring mailings in a relatively short period of time.” shown in the explanatory note.
The law states that the police will buy electronic devices, and the Special Telecommunications Service (STS) will buy communication services.
Electronic monitoring devices are installed on the supervised person, respectively, they are transferred to the protected person in the case of issued protection orders, temporary protection orders and European protection orders, starting from the date of entry into force of SIME.
SIME will be designed to enable the display in the Geographical Information System of the Unified National Emergency 112 (SNUAU) of the location data associated with the electronic monitoring device worn by the person under surveillance, respectively, worn by the person , which is protected, at the time the notification is initiated.
The location data in SIME includes both the geographic position and the location accuracy associated with the electronic tracking device, as well as the time coordinates associated with the determination and transmission of each geographic position.
The police will need 497 officer positions and 5,637 agent positions. Impact on the budget
The rationale states that this entire electronic monitoring system will affect the state budget by an average of more than 82.5 million lei over 5 years.
The resulting budgetary impact is determined by the need to supplement the maximum number of positions for the Romanian police with 497 police officer positions and 5,637 police agent positions.
The addition of the maximum number of posts for the Romanian police should be carried out in stages, depending on the evolution of the electronic monitoring activities in the pilot system as follows:
- a) at the first stage – with the number of 651 positions, including 47 police officers and 604 police officers;
- b) at the second stage – with the number of 2,534 positions, including 191 police officers and 2,343 police agents;
- c) at the third stage – with the number of 2,949 positions, of which 259 are police officers and 2,690 are police agents.
The draft DG also provides fines from 500 to 1000 lei if the person under supervision does not comply with the obligation to inform the supervisory body in advance about the date/time of departure from the country.
