From January 1 of this year Exceeding by less than 5 km/h no longer results in deduction of points. A long-awaited event that should please a large part of the more than 8 million drivers who stupidly lose points every year several km/h too much. Auto Plus answers your questions related to this new event.
“My statement is dated December, should I pay now or wait?”
It is better to wait, as the lawyers interviewed on this topic say. Because at the moment nothing is clear: is it that the date of the speed violation which is taken into account for scoring, or payment what makes it possible to establish the reality of an offense under Article L.223-1 of the Traffic Code? No text yet lays down the rules, If in doubt, take your time and take advantage of the thirty days provided to benefit from €45 or €90 on any electronic payment.
“Is recorded speed or stored speed counted?”
This is the selected speed. It is normal, because a technical margin (or a margin of error) is necessarily applied to measuring devices. For stationary video cameras, it is 5 km/h to 100 km/h and 5% more; and for radar cars – 10 km/h or 10%. For example, on a lane with a 50 km/h limit. you will not be deducted points if you are checked at 56, 57, 58 or 59 km/h (fixed speed), then the selected speed is respectively 51, 52, 53 and 54 km/h. It’s the same if you’re flashing 96, 97, 98 or 99 km/h in a 90 km/h lane. The selected speed is 91, 92, 93 and 94 km/h.
“Are the points not deducted if we are checked in the city?”
The removal of the output of one point for a maximum of four kilometers is applied without location discrimination or speed limit. On the other hand, the fine remains to be paid (if the fine is not contested). It’s €68, reduced to €45 if overtaking takes place in a lane with a speed limit of more than 50 km/h; €135 reduced to €90 if the speed limit is a maximum of 50 km/h, in the city or elsewhere (table).
“Does this measure change anything for bosses who have a duty to expose?”
Nothing at all. They absolutely should continue assigning the employee blink even a kilometer too many, and even if there are no more points at stake. Failure to do so will result in a non-designation notice and a fine of €675, reduced to €450, increased to €1,875. Real tiles.
