City rodeo: will the vehicle be confiscated soon?

While wild rodeos continue to disrupt the peace and tranquility of local residents in several French cities, a corresponding bill was registered in the National Assembly on December 5. And it could very well embarrass those who committed these crimes if they voted for him.

Indeed, Puy-de-Dôme MP Lawrence Wiczniewski has introduced a bill aimed at putting an end to this criminal behavior by proposing a stronger response than criminal sanctions alone.

Greater severity

The August 3, 2018 law qualifies these motorized rodeos as “breach of specific security or due diligence obligations”, which is punishable by one year in prison and a fine of €15,000, or even two years in prison and a fine of €30,000 in the case of repeated violations at meetings. In reality, these sanctions are rarely applied, and criminals have little to worry about.

The bill would give a criminal judge the power to confiscate a vehicle used during a rodeo, even if it does not belong to the guilty party.

Punishment measures are still unclear

Courts currently have difficulty ordering the confiscation of a vehicle, often under contract with a rental company or third party, as the law limits this measure to “vehicle belonging to the convicted person”.

It is for one of these reasons that sometimes people who have grossly violated the speed limit do not have their vehicle impounded for the simple reason that the registration document is not in the name of the offender.

In case of confiscation of the vehicle, the owner of the vehicle, who did not commit the offense, will nevertheless have the opportunity to file a lawsuit against the guilty party.

This confiscation could be declared instead of imprisonment or in addition to it, depending on the provisions of the text.
