Collection rules: what the law says
In France, payment of duty is mandatory. This is article R419-1 of the Road Traffic Rules who says so According to it: “Any user of a road structure open to public traffic, which is regularly subject to a toll, must: unless he has a special permit, pay the amount of toll allowed according to their journey and the category of vehicle they are using. There is nothing surprising in this. But what happens in case of fraudif the user passes the toll barrier without paying?
Payment fraud: what the law says
Tax fraud is punishable by a fixed fine of €90. We must add to this duty amount including unpaid taxand possibly the advantage of a bridge connecting the island to the mainland (depending on the location of the offense). The total amount must be paid within two months after sending the payment message. Outside this period, the fine was increased from 90 to 375 euros ! Also be careful, after 5 consecutive fines in less than 12 months the state can impose a large fine of 7,500 euros.
Finally, note thatthe fine is subject to appeal within 2 months after receiving payment notification. It contains a “dispute card” which must be returned completed and accompanied by the necessary supporting documents.
