From 2022, the activity of issuing Individual Anticipated Fiscal Decisions (SFIA) has moved from ANAF to the Ministry of Finance, which has been a request of the business environment for a long time. Daniel Angel, partner, head of the tax and legal advisory department, found that things were not going as they should.

“As a business environment, we requested the transition from ANAF to the Ministry of Finance. Our wish has come true, but everything is not going as we would like, almost at all,” Angel said.

On the contrary, he declares, “I have seen the decisions of the DIFI, which are the decisions of the fiscal inspection.”

“The taxpayer voluntarily comes to the Ministry of Finance, transparently. Before starting the activity, he asks himself questions about the regulation of things and wakes up 3-4-5 years later with positive decisions issued by ANAF, only to finally find that the decision is negative, but also with amounts given as a possible control. The authority of the SFS Institute was completely exceeded,” he explained.

According to him, everything worked at ANAF, for better or for worse, but they worked.

“I think that it would also be good to adjust the composition of the team, their prerogatives and goals,” the representative of PwC also noted.
