
From June 1, 2024, ANAF will tax 70% of the money of individuals, if it is not justified and not declared, instead of 16%, as now, according to Law on new taxes (296/2023). There are some practical aspects regarding the application of this new percentage, if we refer to the current control or the one that starts on January 1, 2024, as Dan Manolescu, president of the Chamber of Fiscal Consultants, told us in an interview with HotNews.ro.

“It says that it will effectively apply from June 1 for all tax rulings issued since then. This means that people who are in control now and for whom control does not end by then or who will be in control in the next period will be in a situation of paying a significantly increased tax from 16% to 70% just because the ruling is issued later.” – said Dan Manolescu.
So, he says, those who may already be in control will somehow rush to negotiate with the IRS to say, OK, let’s see what I have to pay, that I’d rather pay 16% than 70%.
Others who gain control in the next period will find they pay a higher rate, even though the income assessed by the Inland Revenue relates to some past period when the rate was lower.
As a transitional provision, the solution would be, in his opinion, not to apply this 70% quota to them.
- “They are already, as a procedure, in the process of review and should have used the existing quota. If the corresponding amounts are set in the past, then let 16% remain.”
“The text is pretty clear, I’m saying it applies from June 1st for decisions issued after, which will obviously cause problems for those people who get decisions from June 1st because they will be subject to the 70% quota,” Dan Manolescu also confirmed.
