Donald Trump cannot secure justice in New York by guaranteeing that he will pay a $454 million fine for financial fraud in his real estate empire following his civil conviction in February, his lawyers conceded on Monday.

In a 5,000-page legal document released online Monday by the New York State Supreme Court’s Appellate Division in Manhattan (the trial court), the former US president’s defense said it was “virtually impossible” to guarantee that amount.

“The total judgment plus interest is in excess of $464 million,” $355 million plus $100 million in interest for Donald Trump and $8 million plus interest for his sons Donald Jr. and Eric, “and very few companies envision a possible guarantee (a legal obligations) are close to this size,” protest lawyers who say they have contacted about thirty insurance companies.

This means that, in the absence of a 100% guarantee of the fine, the appeal filed by Donald Trump in February to another court, but without re-examination, will not have a deferred effect: thus, the businessman and political tribune will have to pay the entire amount by March 25, under the threat of the seizure of part of his real estate.

The Republican presidential candidate on Monday night condemned the “witch hunt” and accused the fine of being “unconstitutional, un-American, unprecedented and virtually impossible for any company, including a successful company like mine.”

The Appellate Division of the New York State Supreme Court rejected a $100 million bail offer on February 28.

The former president and his two adult sons also appealed three-year and two-year bans from doing business in New York state, respectively.

In February, their lawyers assessed the amount of the fine as “exorbitant and offensive” and the “general ban” on doing business in New York as “unlawful and unconstitutional”, already considering it “impossible to provide and provide a full guarantee”.

In a historic decision dated February 16, New York judge Arthur Engoron ordered the former president to pay $354.86 million in fines for financial fraud, and each of his two sons – four million dollars each.

New York State Attorney General Letitia James filed a complaint against Donald Trump in October 2022 and forced him, his sons and their Trump Organization to begin a civil fraud trial from October to January.

The businessman, who made his fortune in real estate before disrupting the world’s first superpower’s democracy, slammed the “totally unfair” trial, publicly lashing out at magistrates James and Engoron.
