Donald Trump warned on Tuesday that he may order the Justice Department to file charges against Joe Biden if he returns to the White House after the election this November, Reuters reported.

Trump made the comments as his lawyers prepared to argue in court in Washington that the former Republican president should be granted immunity from criminal charges related to his alleged attempts to overturn the results of the November 2020 presidential election.

Trump’s defense team will try to convince a three-judge federal panel that the charges against him should be dismissed before a trial scheduled for March.

But with the US presidential campaign in full swing, Trump used the hearing to again accuse him of being the victim of political harassment.

The Justice Department in Washington has always argued that US presidents cannot be impeached for their actions while in office, but Trump says the custom should apply to them after they leave office.

In a video message published on his social network Truth Social, Donald Trump said that if federal judges do not dismiss the charges against him, he, in turn, may sue Joe Biden if he becomes president again.

“If I don’t get immunity, corrupt Joe Biden won’t either. Joe would be ripe for impeachment,” said the former Republican president.

Trump has a large lead in the polls for the Republican nomination for the higher office, explaining this by his refusal to participate in debates with other candidates.

Special counsel Jack Smith, who is leading the Washington case against Trump, argued that granting former presidents immunity would give them a legal shield under which they could commit a wide range of serious crimes.
