Kornel Diniku’s lawyer believes that the preventive arrest of his client after the fire in Ferma Dacilor is an “anathema” and the reasons are “childish”.
- “If we start with some empirical hypotheses, with simple assumptions and probabilities – even the ISU report gives some probable hypotheses and does not draw conclusions of a technical and scientific nature – it seems to expose this person to anathema and put this entire criminal solution in jeopardy. It is too much for me at this moment, when we are at an early stage of the criminal process and we have to discuss harshly what a public danger this person represents, in the drama he is going through, to bear the consequences of the strictest preventive measure,” said lawyer Janku Toader in Saturday on Antena 3, News.ro reports.
He believes that the prosecutors who indicted Dinik in the case of the fire in which eight people died, appeared before the court out of “childish” motivation.
- “If at that time you thought that it was not a public danger and left the person behind a Christian and so on, you did not think that it was a public danger, suddenly after a few days you find that preventive arrest is imposed because of ridiculous considerations, as if it is necessary to remove from the community because he is a danger, and thus an example will be made to public opinion. However, we do not judge emotionally, not even by public opinion,” says the lawyer.
He believes that the prosecutor’s office “is obliged to collect evidence not only against the defendant, but also in his favor.”
What the lawyer says about illegal networks
Asked by Digi24 whether Ferma Dacilor was connected to the grid legally or illegally, lawyer Janku Toader said “some truncated interpretations taken out of context are being tried”.
In addition, regarding the understated dimensions of the transformer station, he accused NARE of not responding to the messages of the representatives of the pension fund.
He emphasized to “Anteni 3” that his client made numerous “approaches” to obtain approvals and permits from state institutions.
“If you also look at the content of the prosecutor’s report, the report on the motion for remand, you will notice that it mentions, but in a very limited way, what Mr. Diniku tried to do by doing his due diligence, even more than what ISU required him to do to receiving this permission,” Janku Toader said.
Kornel Diniku, preventive measure in the form of detention
On Wednesday evening, the magistrates of the Ploiesti court accepted the proposal for preventive arrest made by the prosecutors of the Prosecution of the Prahova court on behalf of the controversial businessman Kornel Diniku, the one who founded and actually manages the tourist complex Ferma Dacilor in the town of Tohan.
Administrators of pension documents, Adrian Vitomir Ristin and Adelina Elena Ilye, received house arrest warrants. All three are charged with the crime of willful destruction causing disaster. โBusinessman Cornel Diniku, who founded and ran the Ferma Dacilor tourism complex, and two administrators challenged the arrest warrants in documents.
Next week, on Tuesday, the Prahova court will hear the appeals filed by Kornel Dinik against a preventive arrest warrant, as well as two other defendants against house arrest warrants in the case of the fire in which eight people died.
Ferma Dacilor filed a criminal case
Meanwhile, Janku Toader told Digi24 on Saturday that the company that managed Ferma Dacilor filed a criminal complaint after the fire.
“A statement about a criminal offense was recently filed by my colleague, who is with me in the team (…) from the company, obviously related to the circumstances of this accident. This is not a complaint against a person,” said the lawyer.
He clarified that the complaint is “subject to the thesis” according to which this fire could not have happened “other than as a result of a criminal act.”
When asked whether the complaint refers directly to the electric power company or NARE, the lawyer answered: “Given that this complaint was registered, a response was received, this file will be analyzed together with the main file, as it is the subject of a court proceeding. criminal investigation, I cannot provide more detailed information because I would violate a legal obligation called the non-public nature of a criminal investigation.”
Danish farm illegally connected to the grid
The tourist complex complained to NARE that it has problems with electricity, although it is connected to the network illegally.
According to the response of the National Energy Regulatory Authority (ANRE) to a request from HotNews.ro, the electrical installations of Ferme Dacilor were so small that it was necessary to build a new transformer station to cover all consumption needs.
ANRE says that in May it received complaints from representatives of the boarding house about voltage fluctuations in the network and asked the local electricity distributor DEER (formerly Electrica Distribucie) to check the situation.
DEER discovered that the guest house was actually getting its electricity from a point of consumption 650 meters away, which had a water pump permit and a certificate of connection to a residential building with photovoltaic panels, when in fact it needed an entire transformer station to cover its consumption.
The Dacian farm is powered by a 650-meter cable
In the response to HotNews.ro, ANRE clarifies that in May 2023 it received a complaint from Alina Florentina Celacu on behalf of the company Ferma Dacilor Production, who complained about the inconvenience caused by low voltage at the point of consumption in the municipality of Gura Vadului, village of Tohani, main street No. 76B.
ANRE asked the distributor in the area, DEER, to urgently take the necessary measures to ensure the quality of the electricity distributed at that point of consumption and to monitor the voltage curve for at least seven days, and then send ANRE and the plaintiff the results of the monitoring.
On June 28, DEER notified ANRE and the claimant that the power supply to this point of consumption is via a three-phase connection connected to the low-voltage electrical network in accordance with the technical connection notice issued in 2014 for the water facility. pump” connected to the Tohan Sat substation with an approved capacity of 8 kW.
DEER said it issued a certificate of connection on May 29, 2023 for the purpose of “residential plus PV”, which also has a capacity of 8 kW. Although the connection certificate stated that no other users are allowed to be connected, the farm is fed from here via a 650 meter long installation.
In addition, DEER showed that the farm applied for grid connection in 2022 for a new consumption location, i.e. an agritourism guesthouse, but a new transformer station had to be built to cover the consumption needs.
The values โโof electric voltage in the network in the area were normal
The distributor also sent the regulator to check the voltage readings at the Tohani Sat station and they were within normal limits.
At the same time, NARE states that it has not received any appeals or complaints from residents of the district regarding possible voltage fluctuations in the period from November to December 2023.
Kornel Diniku criticized the authorities
In an interview with Observatorul Prahovean in November 2022, Kornel Diniku criticized the government, which he said was moving slowly.
“The system is very cumbersome and very complicated. It doesn’t help, it just confuses. I wish the system would stop confusing me, so that everything would be easier. That we are not doing anything illegal…”, Kornel told Diniku at the time.
He complained about the slow reaction of the authorities, and to illustrate, he said that the building permit for the building, where the restaurant is now located, lasted for four years.
Diniku told the story that the boarding house is connected to the electricity supply network, but its power is not enough, so he brought a generator to the boarding house. “We have generators. We have… The state also provides some electricity. I’ve been applying for about 10 years, I’m still waiting for them to increase our capacity, to lower the middle line,” said the businessman.
The victims had no chance
And the prosecutors who conducted the case claimed that the hostel operated in systematic violation of the law.
The chances that the victims of the fire at Ferma Dacilor could be saved were almost non-existent, given the numerous problems the guest house, which was connected to the electricity network from a water pump owned by an individual, was having. with a capacity of 8.00 kW, which is insufficient to maintain the boarding house, it is stated in the document with the prosecutor’s proposal for arrest.
Businessman Cornel Diniku, who founded and managed the Ferma Dacilor tourist complex, claimed that the fire, which killed eight people, was deliberately set.
Forensic experts have identified the last victim of the fire in Ferma-Dachilor on Friday. It was 11-year-old Petre Ene, who died with his 16-year-old brother Luca and their father Lucian. The victims were identified by DNA.
