Save Bucharest collected from citizens’ donations the amount needed to pay the legal costs of One Mircea Eliade Properties, for which the developer obtained the dissolution of the NGO in the first instance. From December 22 to 28, more than 550 people donated about 13,000 lei.

“Thank you to everyone who helped us these days. We are overwhelmed by the solidarity with our cause that so many people have shown. More than 550 people donated more than 130,000 lei to the Save Bucharest Association from December 22 to today. The amounts remaining to be recovered have already been collected from the Association’s account by the bailiffs employed by One, which has thus recovered all legal costs awarded to it and to Auchan Romania. We are confident that the Bucharest Court will accept the appeal and preserve the existence of the Association to Save Bucharest,” said the statement sent on Thursday by the Association to Save Bucharest.

About the dissolution of Save Bucharest through the court

Last week, Hotnews.ro wrote that the developer company One Mircea Eliade Properties obtained through the court the dissolution of the Save Bucharest Association. The decision was handed down by the 5th Circuit Court on December 20 and is not final. Save Bucharest is not the only association for which One Mircea Eliade Properties demanded dissolution. And the “Spiritual Militia” Association, which demanded in court the annulment of the environmental agreement and the permission to build One towers in Hala Ford, Floreasca, was dissolved this year after the court decided it at the request of the same developer – One Mircea Eliade Properties SRL. The reason: he lost his lawsuit against the developer and did not have the money to pay the legal fees.

The Save Bucharest Association, together with the SOS Orașul Association and the Spiritual Militia, was a party to two lawsuits against the Hala Ford real estate project:

  • file 25248/3/2018, in which the environmental agreement initiated by the Save Bucharest Association and the Spiritual Militia Association was challenged
  • file 4858/3/2019, in which the PUZ and the building permit were challenged, initiated by Save Bucharest Association and SOS Orașul Association.

The courts rejected the claims and charged the following costs:

  • 95,000 lei for One and 130,000 lei for Auchan in file 25248/3/2018
  • 50,000 lei for One and 25,000 for Auchan in file 4858/3/2019.

“Since the three NGOs were unable to pay these amounts, One initiated legal proceedings to liquidate them. The Society “Spiritual Militia” could not pay and was dissolved by the final decision. The SOS Orașul Association collected and paid One 50,000 lei and demanded that the dissolution action be annulled as One returned its money. To Auchan’s knowledge, One also bought the Auchan lawsuit from Auchan for 25,000 lei and demanded the liquidation of SOS Orașul for that amount. The SOS Orașul association also collected and paid the sum of 25,000 lei. The final decision on the dissolution of SOS Orașul will be issued by the Cluj court in January 2024,” said a press release sent to Save Bucharest on Friday.

Asociația Salvați Bucharestul collected and paid 95,000 lei to One and demanded that the dissolution action be dismissed as One returned its money.

“With Auchan One’s knowledge, it also bought Auchan’s debt of 130,000 lei and demanded the dissolution of the Bucharest Preservation Association for that amount as well. The Save Bucharest Association managed to collect 70,000 lei of the amount originally owed to Auchan and asked for a stay of the liquidation action until it was determined whether it would have to pay the legal costs in full or only half if it acted together with the Association spiritual militia. , dissolved. District Court No. 5 rejected the request for postponement and decided, first of all, to dissolve the “Save Bucharest” Association. We believe that if we also pay the remaining 60,000 lei, the Court of Appeal will accept the appeal and let Save Bucharest Association exist,” the statement added.

Diaconescu accuses the NGOs of trying to block the construction site because of several complaints and damaging the company’s image, and the court-ordered legal costs are minimal compared to the damages.

“The individuals who hide behind these community organizations and coordinate their activities have tried to block the activities of the construction site through countless reports to regulatory authorities, manipulating tenant associations around the project, harassing and threatening workers on construction sites and even by filing criminal charges (and dismissed as unjustified). These legal costs, awarded by the courts, are minuscule compared to the cost of the project, not even covering 1% of the total damage caused to the company, materialized in terms of hindering sales, alienating investors, delaying funding and affecting the group’s image. All 9 (nine) disputes were resolved in favor of One Mircea Eliade Properties, as it was demonstrated that the development of One Floreasca City is based on all the necessary documentation and permits issued by the competent authorities, strictly following the letter of the law. and procedures specific to the field in which we work,” says Andrei Diaconescu.
