The Ministry of Economy, Entrepreneurship and Tourism declares on Wednesday evening regarding the boarding house Ferma Dacilor, which burned down and took the lives of several people, that the institution does not have the authority to submit documents for obtaining a building permit, urban planning certificate or fire safety permit in view of the classification of the procedure. The ministry also notes that the boarding house had a 1 star category certificate.

The company that owns Ferma Dacilor applied in April 2017 for a permit to rent 3-star rooms and a restaurant of a 2-star boarding house, but due to violations, the authorization file was closed, and in November 2017, the company was fined 40,000 lei. because it did not have a classification certificate. In December 2017, another file was received with a request to assign part of the rooms to the 1-star category. In March 2018, Ferma Dacilor received a classification certificate for rooms for rent category 1 star, for 14 places of accommodation for 28 places.

According to the Ministry, a classification certificate is a document issued by a central state institution responsible for the field of tourism, which is a codified form of a synthetic representation of the level of comfort, quality of facilities and services provided within the tourist and reception facilities with the functions of accommodation and/ or catering.

• “Regarding the situation regarding the documentation submitted by SC FERMA DACILOR PRODUCTION SRL, for classification, according to the results of checking the database of the Department of Authorization and Monitoring – General Directorate of Tourism, we note that on March 6, 2017, the mentioned company in this regard submitted a file for the authorization of numbers 3-star category for rent and 2-star boarding house restaurant.
• However, although a provisional permit for classification was issued after document verification, on 27 March 2017, during the visit of the field control team on 12 April 2017, several non-conforming aspects were identified and a classification note was drawn up, with no. 5158/12.04.2017, by which a series of measures to eliminate malfunctions with a deadline of 7 days according to Art. 8, par. 4 OPANT dated 10.06.2013. Given that the legal deadline was not met, the file for authorization was closed and a notice was sent to resume the procedure for submitting a new file.
• According to the Control Office, based on the results of notification No. 28704/14.11.2017, an inspection was started, according to the results of which, on the date and time of the inspection, after submitting the invitation No. 0416, he left on 04.12.2017, the submitted documents were checked and it was found that the installation was operating without a classification certificate , issued by the Ministry of Tourism. Thus, the company was sanctioned according to GD 1267/2010, art.16(1), letter a with a fine of 40,000 lei.
• Later, on December 28, 2017, another file was received with a request to assign part of the rooms to the 1-star category. On January 9, 2018, a new preliminary classification certificate was issued, and on March 28, 2018, the team visited the site and issued a classification certificate 31496/27.04.2018 for a 1-star rental premises for 14 places to accommodate a chamber structure. spaces, including 28 seats.
• Thus, in order to provide a classification certificate, the Ministry of Economy, Entrepreneurship and Tourism applied in accordance with OPANT 65/2013, Art. (4), for the classification level required by SC FERMA DACILOR PRODUCTION SRL, respectively rental numbers, category 1 star, strictly the following documents:
• a) standardized request;
• b) a confirmation certificate (extended form) issued by the Trade Register indicating the activities permitted to be carried out at the workplace and the corresponding CAEN code(s) for the relevant tourist reception structure.
• In this case, according to Art. 15 of Law No. 359/2004 on simplifying the formalities for registration in the trade register of individuals, family partnerships and legal entities, their tax registration, as well as for the authorization of the activity of legal entities, with the following changes and additions, for the authorization of its activity, the applicant must also is required to submit a declaration – of the type on own responsibility, signed by partners or administrators, from which it is clear that the legal entity fulfills the conditions of activity provided for by special legislation in the field of health protection, sanitary and veterinary, environmental protection and labor protection, for the specified activity.
• For public institutions, organizations, associations, foundations, religious cults, etc. – a copy of the founding document (government decision, court decision, etc.), a copy of the tax accounting document, statute or document confirming the possibility of carrying out accommodation and/or public catering activities and the document from which the management right (ownership, loan, lease or other right of use) of the tourist accommodation structure(s) derives, as well as the address of the relevant unit(s);
• c) a unified letter regarding the nominal classification of residential premises by categories and types according to appendix no. 4 to the current methodological norms, depending on the circumstances,” the press release of the Ministry says.

At the same time, the Ministry of Economy, Entrepreneurship and Tourism emphasizes that, in view of the classification procedure, in the given situation, did not have the attribute to request other types of documents, such as a building permit, town planning certificate or fire safety permit, their issuance and verification is the responsibility of the municipality of Hura Vadului and ISU Prahova.
