The man arrested for raping the 12-year-old daughter of his concubine was released home by the prosecutors of the Margita Prosecutor’s Office, who did not demand his arrest on the grounds that they were waiting for expert testimony that the girl did not give her consent to sexual relations with the man, writes Bihorean.

The local publication writes that it was informed about this case by sources from the commune of Spinush, where a 12-year-old girl lives with her mother, twin brother and sister in the house of her mother’s concubine.

“In the spring, the saleswoman of the village store saw that her stomach was growing and informed the social worker of the town hall. At school, the girl was called to tell about what happened, but she did not want to say anything. She was taken to the hospital, where it was discovered that she was five months pregnant, and the police were informed,” said a source quoted by Bihoreanul.

After hearing the policeman from the commune, the girl’s stepfather objected. Meanwhile, the girl gave birth.

The prosecutor’s office of the Margit court was informed about this case back in the summer, and on Thursday, when the prosecutors received the results of the DNA examination, the man was detained for 24 hours and a criminal case was opened for sexual relations with a minor, not for rape, writes Bihoreanul. The man was released on Friday.

“Until we have black and white evidence that the girl did not consent to intercourse, it is inappropriate to ask for precautionary measures (…) DGASPC has been informed. The girl and her child have been taken away and are in a shelter for abused minors,” he told Bihoreanul. prosecutor Aleksandra Lup, spokesperson of the prosecutor’s office of Margita.

When asked whether the decision to release the man was related to the protest in court, the representative of the prosecutor’s office said: “We can also take this into account (…) We will conduct this examination and, depending on the result, we will demand the adoption of preventive measures.”
