
Cars in which drugs are found can be partially or completely confiscated; penalties will be increased for drug users; video recordings, including those made by other drivers while driving, can be used as evidence to establish offenses; police officers will be tested for the presence of drugs and alcohol while on duty, and drivers who refuse to undergo a drug or alcohol test may have their car immobilized, according to the draft legislative changes presented for public discussion by the Ministry of Internal Affairs on Friday evening. .
Projects presented by the Ministry of Interior for public discussion:
- the draft Law on Amendments and Additions to Regulatory Acts on Preventing and Combating the Trafficking and Illegal Consumption of Narcotic Drugs and Substances with a Psychoactive Effect;
- a draft of the Government’s emergency order on amendments and additions to some regulatory acts in order to improve road safety;
- draft Law on Amendments and Additions to Law No. 360/2002 on the Statute of Police Officers and Law No. 80/1995 on the status of military personnel.

In the field of prevention and countermeasures against the circulation and illegal consumption of narcotic drugs and substances with psychoactive effects, the MAI reports:
- increasing the penalty limit with deprivation of liberty, applied in the case of a criminal act consisting in encouraging a person to illegal use of high/high-risk drugs, from 6 months to 3 years, as now, up to 1-3 years, for high-risk drugs, respectively, imprisonment from 1 up to 5 years for drugs of increased danger. In addition to a penalty of 1 to 5 years of imprisonment, a sanction is proposed for advertising any product that credibly claims that it produces drug-like effects when consumed.
- the regulation of circumstances aggravating punishment, which consists in the possession of narcotic drugs for the purpose of consumption in a medical, educational, military institution or unit, places of deprivation of liberty, centers of social assistance, re-educational or medical-educational institutions, places of stay of pupils, students. and young people engage in or around educational, sporting, social activities, believing that such behavior creates new risks in the matter, such as giving it to others or promoting drug use.
- establishing a set of conditions that must be met in order for a person who has committed one of the prescribed drug offenses to benefit from a halving of the statutory sentence limits, thus supporting the removal of more and more drugs from the market by encouraging traffickers to cooperate with the police.
- considering that the ownership of vehicles facilitates the movement of drug traffickers to commit new criminal acts, special confiscation of vehicles is proposed, in whole or in part, in which highly dangerous/highly dangerous drugs were found or which were used in any way to commit a crime.

The following changes will take place in the field of road safety, according to the MAI:
- to oblige the police to check drivers in certain situations, for example, when the vehicle is checked for alcohol containers with traces of consumption or substances that may have a psychoactive effect, or if the driver of the vehicle appears in the police records with mentions of drug trafficking or use of psychoactive substances or alcoholic beverages;
- suspension of vehicle registration in the absence of mandatory civil liability insurance of vehicle owners, for damages caused to third parties as a result of traffic accidents;
- recidivism in the case of driving a vehicle while intoxicated, which does not constitute a crime, will be punished more severely. The term of suspension is increased each time an offense related to driving a vehicle under the influence of alcohol is committed within 5 years, with crediting to the term of suspension established for the previous act;
- elimination of the possibility of applying a warning for violations with increased severityfor example, driving under the influence of alcohol, taking into account the consequences that may arise in the event of such actions;
Video recordings made even by other drivers can be used by the police to detect violations
- establishing a mechanism for moving legally parked vehicles to achieve common interests, without violating the rights of drivers. The purpose is to prevent or limit the consequences of accidents, disasters or catastrophes or to facilitate the emergency intervention of competent authorities in order to protect the life and integrity of certain people or public or private property;
- use by the police stationary traffic monitoring systems of the local state administration to detect gross violations and prosecute drivers;
- regulating the possibility of that a traffic police officer can detect certain violations with the help of an audio-video or video recording of another traffic participant;
- stopping traffic or towing a vehicle if the driver refuses to undergo a drug or alcohol testand the driving of the vehicle cannot be ensured on the spot by another person.

Amendments to the Statute of the Police and Law No. 80/1995 on the Status of Military Personnel, according to the MAI:
- INSTALLATION a mandatory drug test during a medical examination for admission to educational institutions of the Ministry of Internal Affairs or for employment in the police. Fulfillment of the condition must be determined through a medical examination and psychological assessment, after which, in case of non-fulfillment of the condition, the recruitment procedure for the relevant candidate is terminated;
- establishing an obligation for police officers and military personnel, undergo an examination for the presence of alcohol or narcotic substances in the bodywhile on duty or while wearing uniform or issued equipment.
- establishing the obligation of a police officer to undergo a test to detect simulated behavior (polygraph), if certain signs of dishonesty and professional integrity are found;
- removal from office a police officer or military officer, when the tests conducted establish the presence of drugs in the body or when he refuses to submit to the taking of biological samples, as well as in the event that he does not support the assessment of simulated behavior;
- awarding of police officers regarding the criteria for the effectiveness of activities that led to the seizure of significant amounts of drugs, prohibited substances, weapons and ammunition, disposal of large sums of money, as well as reports of corruption.
