About what the head of the Central Committee of the Central Committee conveyed to the Chinese delegation

According to the institution’s press release, CCR President Marian Enake presented the constitutional evolution of Romania as a member state with full rights in the European Union, the procedure for appointing constitutional judges, the powers and consequences of the decision of the Constitutional Court.

He also emphasized that Romania has “serious traditions in terms of constitutionalism and constitutional culture, as well as the fact that, thanks to the revision of the 1991 Constitution in 2003, new provisions regarding the country’s Euro-Atlantic integration were regulated.”

  • “President CCR also showed that the universal values of the Constitution should ensure respect for the basic rights and freedoms of citizens of the nations of the world, regardless of existing political regimes, and delegitimize attempts to influence or disrupt the constitutional system of each state. These universal values of the constitutional type, in the center of which are the rights and basic freedoms of people, should ultimately ensure national and international balance, peace and well-being of peoples.
  • Mr. Marian Enake mentioned the difference between the two constitutional systems, namely the jurisdictional control exercised by a special specialized body located outside the perimeter of the three powers in the state, typical of Romania and the European model, on the one hand, and the political constitutional control exercised by a commission established at the parliamentary level, on the other hand, stating that the model of constitutionalism is the political choice of each state.
  • The President of the SSR emphasized the fact that constitutional justice is an indispensable condition for the rule of law in any democracy, and that every constitutional court is a court of rights and freedoms, which are the core of the rule of law,” the message reads. What is the role of the Constitutional and Legal Commission

Xin Chunying, who clarified that this is his first meeting abroad after being elected, said that his country does not have a separate court like Romania, so the Constitution and Law Commission is a very important body in the application and promotion of the Constitution.

According to his presentation, the Constitution in force in China was adopted in 1982 and has been changed five times according to the American model through draft amendments, to date their number is 52.

Xin Chunying explained that this system with the draft amendments was chosen considering that an important role of the Constitution is to be predictable, and that the public should see the stability of this Chinese model. In this sense, he showed that the 1982 Constitution contributed to China’s transition to a market economy.
