There is no money in the budget, so everyone should be taxed more, the PSD-PNL coalition believes. We are in love with the idea of ​​eliminating facilities, but the proposals of the ruling coalition go far beyond that. No one will be left without accusations if we look at their announcements, as well as the drafts circulating in our press (we also published a couple of versions).

Entrepreneurs more jokingly, and more seriously, ask themselves the question: am I a thief or not?

Why is this being asked?

Because the two Marcels (Marcel Cholaku and Marcel Bolosh) almost directly condemn companies that are profitable, unprofitable or loss-making in their statements.

What did the entrepreneurs understand?

1. If you lose, you are a thief

The representatives of the PSD-PNL coalition believe that if you are not making a profit, it means that you are doing something illegal or close to the law to hide your profits.

True, there are companies that are engaged in tax optimization (not illegal affairs), and others less so. Of course, there are companies that do evasion. Since ANAF has no way to monitor or identify those companies that avoid paying taxes, the Coalition’s solution is: “we tax everyone, because surely all companies do.”

This is easier to do than to strengthen ANAF.

So if someone is avoiding (rather than optimizing) taxes, it means you are too. So, dear entrepreneur, you are considered a thief in the eyes of the Coalition if you have a loss.

2. If you have a small profit, you are a thief

A small profit is also not suitable for the same reason described above. The Coalition thinks you’ve done a lot of tax streamlining (no evasion this time).

You didn’t do anything illegal per se, but the fact that you managed to get a little less profit, the state doesn’t like. It was necessary to declare a larger one so that the income tax came to the budget more stably.

I mean, it’s like you stole the state, according to the concept of the ruling coalition. So you better charge extra.

The same applies to PFA. For example, according to statements made available to us by Marcel Bolosh, the Minister of Finance, if you have slightly higher incomes, you benefit from the CASS payment cap. If you don’t have a lot of income… bad luck, you will pay CASS 10% of what you earn.

3. You have a large profit, you are a thief

Too much profit is also not good. If your business is doing very well, maybe you discovered a market opportunity, a product or service that didn’t exist but was needed and you made a big profit, that’s bad.

You stole somewhere, no one knows where, but something unclean, according to the Coalition.

We have also found a form of additional taxation for you, so that you can give more money to the state. Are you doing well? The state must do the same: it must pay salaries and pensions next year, run a deficit, etc.

One way or another, the state never has enough money, so it borrows a lot.

How profitable do you have to be to not be considered a thief?

Now the question is: how profitable do you have to be to not be considered a thief?

Well, in this regard, even the Minister of Finance, Marcel Bolosh, told us the figure in an interview with HotNews.ro.

For micro-enterprises, “this rate of return of 30% is introduced because it is believed that this rate of return will be the benchmark from which we further consider that the micro-enterprise is used as an area of ​​fiscal optimization”.

So, analyzing his statement, if you have a micro-enterprise with a profitability of more than 30%, of course you are engaged in tax optimization (it is not against the law), but the state does not like it.

I mean you would be a thief so you have to pay more.

If you have less than 30%, then see that you are not too low, that is, close to zero or in the red – if you are not doing well because you are “falling into the same sin”.

If ANAF had a better administrative capacity, it would be easier for the Coalition: it would only focus on eliminating exceptions, and everything would be resolved more easily. The tax office saw evasion, in some cases it can stop it, and we were quiet today. Everyone stopped being taxed wholesale, and then all entrepreneurs stopped being considered thieves.

The question remains: do the Coalition consider those who invest in the party to be thieves?
