Former CCR judge and Court President Augustin Zegrean says that if the current Constitutional Court respects the old CCR practice, the law on special pensions will not undergo a constitutional review, as the law passed in parliament today “has nothing to do with it”. with legislative technique”. “It cannot be said that the law enters into force in years according to the articles. The law cannot come into effect one at a time, whenever anyone wants.” At the same time, regarding the law to cancel the pensions of parliamentarians, Zegrean said that he expected pensioners from the parliament to attack the law in court, according to News.ro.
Why is the law on special pensions subject to appeal to the KKR
- “First of all, I don’t know if anyone will report these laws to the KKR. I cannot say today whether the law will pass the court or not, I can tell you that if the current court follows the older practice of the KRS, the law will not pass. In Romania, we have a law on legislative technique, how laws should be created so that they are predictable, foreseeable, so that they can be understood by the common man. The law that I saw today has nothing to do with legislative technique, it cannot be said that the law enters into force according to the articles for years. The law cannot come into effect one by one, whenever everyone wants,” Augustin Zegrean told Prima News.
He stated that he could not suspect them of reporting to the KKR. “Rather, I suspect them of ignorance,” he added.
A former judge explained that our law has major enforcement problems and this is also the reason why judges are very busy with two million cases a year.
- “There was a lot of talk about this law and it was made in one day, today it was voted on in one day, this is also a problem for transfer to the KKR. This is not how a law is made, this is an example of how a law cannot be adopted,” Zegrean also noted.
Zegrean expects pensioners from parliament to challenge the law in court
Regarding the law that cancels the pensions of parliamentarians, Zegrean indicated that what parliament does, parliament cancels, and he does not see it as a problem.
He noted that he expects pensioners from the parliament to challenge the law in court.
- “They will invoke the exception of unconstitutionality, and the justice will say that it is unconstitutional,” said Augustine Zegrean.
- “If a fair law was adopted, there would be no problem with the Constitutional Court. Make a fair law and according to the law. I believe that they do it on purpose, or rather out of ignorance,” the former judge also noted.
On Wednesday, the Verkhovna Rada adopted a draft law on the abolition of special pensions. The draft law has undergone changes compared to the version adopted by the Government and agreed with European officials. More precisely, PSD and PNL parliamentarians introduced derogations and exceptions that postpone the application of the reform for the next 5 years and extend the abolition of special pensions for 20 years. The UDR refused to vote for the bill, saying it did not abolish any special pensions.
USR MP Christian Seidler spoke with two buckets in the plenary, saying that today there are 210,000 special pensioners in Romania and another 210,000 special pensioners will be in Romania after the adoption of this law.
