Protocols for violation of traffic rules can be challenged in the court in whose jurisdiction is the place of residence or the location of the fined person, according to the law adopted on Wednesday by the deputies. Fines can now be appealed only in the court in which the offense was committed.

The normative act amends the paragraph of the Emergency Decree 195/2002 on traffic on public roads in the sense that it is provided for the possibility of filing a complaint about the protocol of detection and sanctioning of the violation to the court, on the territory of which within the radius where the person has a place of residence or headquarters the apartment of a person who has been sanctioned, writes News.ro:

  • “A complaint may be filed against the protocol on the detection and application of sanctions to the offense within 15 days from the moment of notification to the court in whose jurisdiction the offense was detected, or to the court in the territory of which the location or headquarters of the offender is located.”

Now a complaint can be submitted only to the court in whose jurisdiction the act was discovered.
